REFLECŢII ASUPRA UNORA DINTRE AMENDAMENTE LE OPERATE ÎN CODUL PENAL PRIN LEGEA nr .64/2013

Abstract

Scopul acestui studiu constă în investigarea unor modificări şi completări operate prin Legea nr.64/2013, punându-se accentul pe reperele conceptuale ale acestora. În special, au fost examinate modificările pe care le-au suportat art.130, 138, 303, 312 şi 314 CP RM. De asemenea, au fost analizate particularităţile şi efectele completării legii penale cu art.1372-1374 CP RM, precum şi ale abrogării art.143, alin.(6) art.364 şi a art.392 CP RM. Analiza conţine multiple referiri la instrumentele internaţionale în materie, precum şi la Nota informativă la proiectul care stă la baza adoptării Legii nr.64/2013.

The purpose of this study is to investigate the changes and additions made by Law nr.64/2013, with special attention on their conceptual items. In particular, there were examined the changes to art.130, 138, 303, 312 and 314 PC RM. Also, there were analyzed the peculiarities and the effects by filling out the penal law with art.1372 -1374 PC RM, as well as the ones after the repeal of art.143, par.(6) art.364 and art.392 PC RM. The analysis contains multiple references to relevant international instruments and to the Explanatory part of the draft law underpinning the adoption of Law nr.64/2013 .
