Abstract
Complicele nu săvârşeşte nemijlocit latura obiectivă a infracţiunii, dar, în procesul pregătirii de infracţiune sau la etapa
săvârşirii ei, acordă ajutor celorlaţi participanţi, în special autorului, prin crearea posibilităţii reale de a duce infracţiunea
până la capăt sau poate favoriza infracţiunea şi infractorul chiar şi după comiterea infracţiunii, dacă favorizarea nu a fost
promisă din timp.
În principiu, comp
licitatea este posibilă la toate infracţiunile, dar în raport cu unele situaţii pot fi duse totuşi unele
discuţii, de exemplu: în raport cu organizarea, instigarea şi autoratul; în cazul infracţiunilor cu subiect special, infracţiunilor
bilaterale, infracţiunilor prelungite, infracţiunilor complexe, infracţiunilor de obicei, infracţiunilor progresive, infracţiunilor
săvârşite cu două forme de vinovăţie etc.
The accomplice doesnot commit the Actus Reus of the criminal offence by himself but, during the process of criminal preparation or on the stage of its commission, this subject is aiding other parties to crime, especially the principal (the author of the crime) by means of creating real possibilities for fulfillment of the criminal act and achieving criminal result, as well as can commit a concealment or acquiescence of criminal offence even after crimi nal offence was committed with a condition that this assistance was not promised previously. As a general rule, complicity to crime is possible in all types of criminal offences but in some special cases there can appear some disputable questions referring the organizing, abetting and coexecution, in case of special subject crimes, progressive and usual crimes, double blame crimes and so on.
