DREPTUL LA UN TRAI DECENT – DIFICULTĂŢI DE ASIGURARE SOCIAL-ECONOMICĂ ŞI JURIDICĂ

Abstract

Incontestabil, statul de drept şi democratic are ca piloni supremaţia dreptului, precum şi garantarea drepturilor şi libertăţilor fundamentale cetăţeneşti ca valori supreme – condiţie imanentă a liberei dezvoltări a personalităţii umane. În cadrul ansamblului de drepturi şi libertăţi fundamentale un rol aparte îl are categoria drepturilor social-economice, dintre care, în mod deosebit, dreptul la un nivel de trai decent, atât prin structura sa, dar mai ales prin mecanismul juridicostatal de asigurare a lui ca element al demnităţii şi liberei dezvoltări a personalităţii umane. În acest articol vom încerca să identificăm, prin prisma analizei şi sintezei abordărilor doctrinare şi a practicii de exercitare, dificultăţile de asigurare a dreptului la un nivel de trai decent şi metodele şi mijloacele de atenuare, cel puţin, a acestor dificultăţi.

It is undeniable that the rule of law and democratic state has as its pillars: the supremacy of law and the guarantee of fundamental citizen rights and freedoms, as supreme values and an immanent condition of the free development of the human personality. Within the set of fundamental rights and freedoms, the category of social-economic rights has a special role, among which, in particular, the right to a decent standard of living, both through its structure, but especially through the legalstate mechanism for ensuring it as an element of the dignity and free development of the human personality. In the given article, we allow, through the analysis and synthesis of doctrinal approaches and practice, to identify the difficulties in ensuring the right to a decent standard of living and the methods and means of mitigating, at least, these difficulties.
