Abstract

Problema drepturilor post-mortem și a securității datelor a dobândit o relevanță semnificativă în era digitală, în special în timpul războaielor. Utilizarea neautorizată a imaginilor persoanelor decedate este larg răspândită pe platforme precum Telegram și VK, adesea dincolo de reglementările tradiționale. Aceste imagini sunt frecvent exploatate în scopuri de propagandă sau dezinformare, ceea ce ridică probleme etice și juridice. Deși legislația Uniunii Europene oferă un cadru juridic privind dreptul la imagine, eficacitatea sa este pusă la încercare de evoluția rapidă a platformelor digitale și de rezistența acestora la cenzură. The post-mortem rights and data security issue has gained significant relevance in the digital age, particularly during conflicts. The unauthorized use of images of deceased individuals is widespread on platforms like Telegram and VK, often beyond traditional regulation. These images are frequently exploited for propaganda or disinformation, raising ethical and legal concerns. While the European Union legislation provides a framework through the right to image, its effectiveness is challenged by the rapid evolution of digital platforms and their resistance to censorship. This research examines how the EU legal framework addresses the misuse of post-mortem images and evaluates its ability to protect the dignity of the deceased from these emerging threats. By identifying gaps in the current legislation and offering recommendations, the study seeks to strengthen legal protections for post-mortem rights. It highlights the importance of adapting legal mechanisms to address the challenges posed by digital platforms, ensuring the dignity of deceased individuals is safeguarded from exploitation in times of conflict.
