INFRACŢIUNILE ATIPICE PREVĂZUTE ÎN CAPITOLUL II AL PĂRŢII SPECIALE A CODULUI PENAL: ANALIZĂ DE DREPT PENAL

Abstract

Acest studiu este consacrat analizei juridico-penale a infracţiunilor prevăzute la art.155 şi 158 CP RM. Conţinutul obiectului juridic special al acestor infracţiuni este atipic. Doar formal, obiectul juridic special al infracțiunilor specificate la art.155 şi 158 CP RM derivă din obiectul juridic generic al acestora (adică, din relaţiile sociale cu privire la viaţa şi sănătatea persoanei). După examinarea obiectului infracţiunilor în cauză, sunt analizate celelalte elemente constitutive: latura obiectivă, latura subiectivăşi subiectul. De asemenea, sunt examinate elementele circumstanţiale agravante ale celor două infracţiuni prevăzute la art.158 CP RM.

This study is devoted to the judicial-penal analysis of the offences referred to in art.155 and 158 PC RM. The composition of the special legal object of the offences in question is atypical. The special legal object of the offences under art.155 and 158 PC RM derives from the general legal object only formally (by the social relations on the life and health of the erson). After the analysis of the object of the respective offences, are onsidered and other constituent elements, namely the objective side, the subjective side and the subject. As well as are analyzed the aggravating ircumstantial elements of the two offences under art.158 PC RM.
