IMPORTANŢA INTERPRETĂRII OFICIALE, NEOFICIALE ŞI CAZUALE ÎN PROCESUL APLICĂRII DREPTULUI

Abstract

De regulă, pornindu-se de la faptul că în practică actul normativ trezeşte păreri contradictorii, a căror rezolvare nu este posibilă fără a se adresa către organul ce a emis acest act, ne ciocnim cu interpretarea oficială, neoficială și cazuală în procesul aplicării dreptului. Organul ce a emis actul normativ conferă putere obligaţională uneia din existentele sau posibilele interpretări, reproduce conţinutul real al actului normativ şi, astfel, înlătură posibilele aplicări diferite. De aceea este importantă aplicarea dreptului prin prisma celor relatate.
