Abstract
Activitatea de mediere a fost practicată din cele mai vechi timpuri. Medierea a fost si este folosită ca o metodă de soluţionare a litigiilor într-o varietate de culturi diferite de mai mult de 3 000 ani. Primul conflict cunoscut, din punct de vedere religios, a avut loc între primii oameni creaţi, Adam, Eva şi creatorul lor, Dumnezeu. În Antichitate, conflictul se afla la baza lucrurilor bune, dar şi a celor negative. In filosofia lui Aristotel se regăseşte prima menţiune a conflictului. În perioada medievală, se considera că, conflictul trebuie eliminat şi înlocuit de o bunătate unilateral. În Evul Mediu, medierea era privită diferit – uneori practicarea ei era restricţionată sau chiar interzisă fiind rezervată doar unor autorităţi centrale. Medierea, în înţelesul ei modern, este atestată documentar din anul 1680. Începând cu anul 1980, apare conceptul de ADR (Alternative Dispute Resolution).
The mediation has been practiced since ancient times. Mediation has been and is being used as a method of settling disputes in a variety of different cultures for more than 3,000 years. The first known conflict, from a religious point of view, took place between the first created men, Adam, Eve and their creator, God. In antiquity, conflict is at the root of both good and negative things. In Aristotle's philosophy is the first mention of the conflict. In the medieval period it was considered that conflict should be eliminated and replaced by unilateral goodness. In the Middle Ages, mediation was viewed differently – sometimes its practice was restricted or even prohibited being reserved only to central authorities. Mediation, in its modern meaning, is documented since 1680. Since 1980, the concept of ADR (Alternative Dispute Resolution) appears.
