Renunțarea la probe în cadrul procesului penal – chestiune de oportunitate sau obligație pozitivă [Articol]

Abstract

Scopul acestui studiu îl constituie expunerea succintă a rezultatelor obținute în urma cercetării instituției renunțării la probe în cadrul procesului penal și constatării faptului dacă aceasta reprezintă totuși o chestiune de oportunitate sau constituie o obligație pozitivă. Printre obiectivele trasate se regăsește: identificarea esenței renunțării la probe în cadrul procesului penal și a incidentelor conexe, a principiului oportunității, precum și a conceptului de obligație pozitivă a statului. Studiul fiind fundamentat pe aplicarea metodelor generale de cunoaștere științifică, precum ar fi: analiza și sinteza, inducția și deducția, comparația și observația.

The purpose of this study is the brief exposition of the results obtained following the investigation of the institution of the waiver evidence in the criminal process and the finding of the fact whether it still represents a matter of opportunity or constitutes a positive obligation. Among the objectives outlined are: the identification of the essence of the waiver of evidence in the criminal process and related incidents, the principle of opportunity, as well as the concept of the positive obligation of the state. The study being based on the application of general methods of scientific knowledge, such as: analysis and synthesis, induction and deduction, comparison and observation.
