Abstract

The international abduction of children, having regard to its civil aspects, is a civil administrative or judicial proceeding, which deals with the illicit movement or non-return of a child, which must be carried out in violation of a right of custody assigned to a person, an institution or any other body acting either separately or jointly under the law of the State in which the child was habitually resident, immediately before his or her removal or return, and together or would have been so exercised, if such circumstances had not occurred.
