LEGITIMITATEA – CONDIŢIE OBLIGATORIE A MENŢINERII PUTERII DE STAT

Abstract

Din cele expuse, putem să concluzionăm că puterea de stat nu poate fi menţinută decât în măsura în care structurile de putere sunt legitime, iar deciziile politice, inclusiv legile exprimă voinţa generală şi nu sunt folosite împotriva unei părţi a populaţiei. Iar legitimitatea unei puteri statale poate fi privită dintr-o dublă perspectivă: ca act al desemnării structurilor de putere (cucerirea sau actul de întemeiere a puterii); concordanţa dintre conţinutul deciziilor politice şi aşteptările celor guvernaţi

We can conclude that state power cannot be maintained just to the extent to which the power structures are legal, and the political decisions, including the laws, express the general will and are not used against part of population. Whereas the legitimacy of a state authority can be regarded from a double perspective: as an act of appointing the power structures (the conquest or the act of power establishing); the accordance between the content of the political decisions and the expectations of the governed ones.
