VIOLENȚA ÎN FAMILIE ÎN MODALITATEA DE IZOLARE, INTIMIDARE,PRIVARE DE MIJLOACE ECONOMICE ȘI NEGLIJARE: ASPECTE JURIDICO-PENALE

Abstract

În articol sunt analizate unele aspecte juridico-penale privind violența în familie în modalitatea de izolare, intimidare,privarea de mijloace economice și neglijare. Autorii au cercetat conceptul de izolare şi intimidare în sensul lit.(b) alin.(1)art.201 1 din Codul penal al Republicii Moldova, precum şi conceptul de privare de mijloace economice și de neglijare(lit.(c) alin.(1)art.2011CP RM). A fost efectuată analiza comparativă a actelor de persecuţie ca contravenţie administrativă şi a faptelor infracţionale de intimidare cu scopul de impunere a voinței și a controlului asupra victimei.Mai mult, autorii propun unele modificări în cadrul incriminator al violenței în familie, care, în opinia lor, va contribui la îmbunătățirea legii penale.In the realm of this scientific article there are submitted to the legal analysis some penal aspects of the domestic violence in the form of isolation, intimidation, deprivation of the economic means and negligence.The authors have studied the concept of isolation and intimidation met in the article 201 1 of the Criminal code of the Republic of Moldova,as well as the concept of deprivation of the economic means and the egligence (point (c)paragraph1)201 1of the Criminal code of the Republic of Moldova). There have been effectuated a comparative research between the acts of persecution as the administrative violation and the criminal offence of intimidation in order to impose the perpetrator’s will upon the victimor in order to control him(her). More over, the authors have proposed several suggestions, which are considered to be relevant for improvement of the penal legislation.
