CALIFICAREA INFRACŢIUNILOR DUPĂ LATURA SUBIECTIVĂ

Abstract

În cadrul acestui studiu se încearcă efectuarea unei analize a laturii subiective sub aspectul rolului acesteia la calificarea infracţiunilor. În acest sens, sunt scoase în evidenţă unele reguli de calificare potrivit laturii subiective. Se demonstrează că infracţiunile în care legiuitorul cere prezenţa scopului în calitate de semn obligatoriu pot fi comise doar intenţionat.Se arată specificul calificării infracţiunilor comise cu intenţie directă şi indirectă. Se argumentează că, în unele cazuri, în textul legii penale forma vinovăţiei poate fi determinată prin procedeul comparării sancţiunilor.Within the undertaken study is trying making an analysis of the subjective aspect as regards its role in the qualification of offenses. In this respect are highlighted some rules of qualification according to the subjective aspect of crime. It demonstrates that crimes, in which the legislator requires the presence of purpose as mandatory sign, can be committed only intentionally. It shows the specific of qualification the offences committed by directly and indirectly intention. It is argued that in some cases, in text of criminal law, the form of guilt can be determined by the procedure of comparison sanctions.
