ALTERNATIVE DE PROTECȚIE A DREPTURILOR DE PROPRIETATE INDUSTRIALĂ A IMM-URILOR ÎMPOTRIVA CONCURENȚEI NELOIALE

Abstract

Alternative de protecție a drepturilor de proprietate industrială a IMM-urilor împotriva concurenței neloiale. Sectorul IMM reprezintă, probabil, cea mai vulnerabilă categorie de subiecți și, corespunzător, cea mai supusă riscului de afectare a intereselor sale prin intermediul încălcării drepturilor de proprietate intelectuală deținute (în particular, drepturile de proprietate industrială). Legislația aferentă protecției drepturilor de proprietate industrială este construită în mod simetric, fiecare dintre actele normative care reglementează regimul juridic al obiectelor respective fiind determinat de existența normelor juridice formulate similar (conform aceluiași model). Astfel, actele normative în cauză reglementează condițiile de protecție a obiectelor de proprietate industrială, precum și aspectele procedurale relevante (subiecți care dețin drepturi de sesizare, autorități competente etc.). Prin urmare, mecanismul protecției obiectelor de proprietate industrială prin prisma normelor legale specificate nu prezintă complexitate semnificativă. În plan contrar, protecția obiectelor de proprietate industrială și a drepturilor aferente împotriva concurenței neloiale impune întrunirea unor condiții suplimentare de ordin material și procedural în sensul apărării drepturilor în cauză. În contextul dat, prin intermediul prezentei comunicări au fost elucidate aspecte specifice procedurii de apărare a drepturilor de proprietate industrială împotriva unor eventuale acțiuni de concurență neloială

Alternatives to the Protection of Industrial Property Rights of SMEs from Unfair Competition. The SME sector is probably the most vulnerable category of entities and, accordingly, is most at risk of harming its interests as a result of infringement of intellectual property rights (in particular, industrial property rights). The legislation related to the protection of industrial property rights is structured symmetrically, each of the normative acts regulating the legal regime of the corresponding objects is determined by the existence of similar legal norms (according to the same model). Thus, the considered normative acts regulate the conditions for the protection of industrial property objects, as well as the corresponding procedural aspects (subjects with the right of referral, competent authorities, etc.). Thus, the mechanism for the protection of industrial property objects in the light of these legal norms does not represent significant complexity. On the contrary, the protection of industrial property objects and related rights from unfair competition requires compliance with additional material and procedural conditions for the protection of these rights. In this context, this Communication will highlight issues related to the procedure for protecting industrial property rights from possible actions of unfair competition.
