Abstract

Inevitably, there are children who end up in the justice system as suspects, defendants and sentenced including to custodial sentences. Of course, the particularities and content of the regulations regarding the implementation of the prison sentence for minors must be adapted to the specifics and development needs of this category of people. This article refers to the basic aspects of the current legal framework for the implementation of the prison sentence for minors, trends and regulatory needs to be approved by the legislator to achieve the purpose of the custodial sentence. Therefore, it should be organized so that the time children stay in detention institutions is as short as possible, to contribute to the social recovery of people and most importantly to prevent antisocial behavior after release from detention.
