CONCEPTUL DE AUTORITATE PUBLICĂ ÎN CODUL ADMINISTRATIV

Abstract

Although the Administrative Code of the Republic of Moldova has already been in force for thre years, in practice there is still controversy and confusion regarding the notion of public authority according to the Administrative Code, as well as the correlation between public authority and related concepts, public institution, public legal person. In what follows, we will determine and explain the legal criteria on the basis of which an entity can be qualified as a public authority under the Administrative Code of the Republic of Moldova. It has to be: an organisational structure or body established by law or other regulatory act, to act under public authority, and to have the purpose of achieving a public interest.
