Abstract

În cazul constatării încălcării drepturilor privind condiţiile de detenţie, garantate de art.3 din Convenţia pentru apărarea drepturilor omului şi a libertăţilor fundamentale, conform jurisprudenţei Curţii Europene a Drepturilor Omului, condamnații și preveniții trebuie să beneficieze de reducere a pedepsei închisorii. In the case of infringement of the conditions ascertained detention, guaranteed by article 3 of the Convention for the protection of human rights and fundamental freedoms, in accordance with the case-law of the European Court of human rights, those convicted should benefit from a reduction in the prison sentence.
