NOŢIUNEA ŞI CLASIFICAREA CONFLICTELOR COLECTIVE DE MUNCĂ

Abstract

The right to work is one of the fundamental human rights and the whole society’s development is inconceivable without labor. Taking into account the fact that frequently the employees’ interests don’t meet the employers’ interests, this estate of affairs leads to occurrence of collective labor conflicts. Respectively the disagreements between the employer and the employees/ their representatives are real premises for collective labor conflicts. The employers must be diligent enough in order to prevent the occurrence of collective labor conflicts, because any collective labor conflict brings certain economical damages for the employers. The present scientific article aims to analyze the aspects that refer to the notion and the features of collective labor conflicts and also the typology of this category of litigations.

Dreptul la muncă este unul dintre drepturile fundamentale ale omului, iar dezvoltarea societăţii în ansamblul ei este de neconceput fără muncă. Avînd în vedere că interesele salariaţilor deseori nu corespund cu interesele angajatorului, această stare de lucruri duce la apariţia conflictelor colective de muncă. Respectiv, neînţelegerile dintre angajator şi salariaţi/sindicate constituie premise reale de apariţie a conflictelor colective de muncă. Angajatorii trebuie să depună diligenţa necesară pentru preîntîmpinarea apariţiei conflictelor colective de muncă, deoarece orice conflict colectiv de muncă nu trece fără careva pagube economice pentru angajatori. În prezentul articol ştiinţific vom analiza aspecte ce se referă la noţiunea şi trăsăturile conflictelor colective de muncă, precum şi tipologia acestor categorii de litigii.
