    JURISPRUDENȚA CA IZVOR DE DREPT: DILEME NORMATIVE ȘI DOCTRINARE

    The article contains a study of the place and value of case law in the system of sources of law. As a result of the analysis of several doctrinal opinions, the author argues that case law is not a source of law, it is an important source of uniform interpretation of law by the judiciary in the context of the dispensation of justice.

    UNELE REPERE PRIVIND IZVOARELE INTERNAŢIONALE ALE DREPTULUI MUNCII

    This article consists of a brief analysis of the matter concerning the category of international sources of labor law with reference to ILO conventions ratified by the Parliament of the Republic of Moldova; to the instruments adopted by the Council of Europe; to treaties or conventions concluded by our country with other states, that regulate aspects of labor law. Also, a comprehensive analysis was carried out upon the structure of the International Labor Organization, which contributed to the formation of an international labor law, highlighting its evolution, activity and role in promoting its labor and social security policy.

    BLOCUL DE CONSTITUŢIONALITATE – LEGALITATE ŞI LEGITIMITATE

    Doctrina juridică în general şi cea de drept constituţional operează în fond cu sintagma „izvor de drept”, având în vedere acte juridice cutumiare şi scrise. Recent, însă, se recurge şi la sintagma „bloc de constituţionalitate”, lărgind astfel izvoarele de drept constituţional ca ramură de drept, incluzând, în primul rând, Declaraţia de Independenţă a statului, precum şi alte acte cu caracter constituţional. În articolul dat vom explica esenţa şi conţinutul, precum şi legalitatea şi legitimitatea sintagmei „bloc de constituţionalitate” şi locul Declaraţiei de Independenţă ca izvor de drept constituţional cu forţă juridică supremă în sistemul juridic normativ al statului.
