Item Studiu empiric cu privire la protecția datelor cu caracter personal în procesul penal(CEP USM, 2024) Cristea, DanielThe interest in this study arose out of necessity, since in the Republic of Moldova over the years no references were made and only the protection of personal data was studied in general, not in the criminal process, and the emergence of the new EU legislative framework , through the adoption of EU Regulation no. 679/2016 and EU Directive no. 680/2016, requires adjustments to be made in the field of criminal proceedings, in order to fully ensure the protection of the personal data of the parties, we refer to the publications of authors from other countries in this sense in order to obtain some points of view regarding the application of legislation in the field. EU Regulation 679/2016 and EU Directive no. 680/2016 provide an updated legal framework based on responsibility for data protection and in criminal proceedings, offering more rights and control facilities than they previously had over their own data and, through therefore, more obligations and responsibilities for organizations that manage data. In this regard, present scientific article aims to research the next aspects of travelling with work purpose: the notion, the procedure, the duration and the legal guarantees of the employees who are travelling with work purpose.Item DREPTUL LA EXAMINARE MEDICALĂ ÎN PERIOADA REȚINERII CA GARANȚIE PRIVIND NEAPLICAREA TORTURII – ABORDARE TEORETICO-PRACTICĂ(CEP USM, 2022) Pozneacova, VeronicaSummary The international human rights treaties provide several guarantees regar- ding the non-application of torture, including the person’s right to notify the fact of detention and place of his or her detention to a third party, the right to have access to a lawyer, the right to independent medical examination, the right to know his or her rights related to the procedural quality and the rules of the place of detention. The medical examination plays an important role within the procedural guarantees, because it prevents the application of torture by criminal prosecution body officer, and it determines the prompt identification of all cases of the application of torture while the person is in state custody. According to the international standards, the person must undergo a medical examination immediately after detention, after each entry, exit from the Police Inspectorate/ The Pre-trial Detention Inspec- torate, as well as before release from the Pre-trial Detention Inspectorate. In the practical implementation of this guarantee, there are certain deviations, related to the lack of qualified medical personnel in the Police Inspectorate, medical non-examination of the person after each entry, exit from Police Inspectorate/ The Pre-trial Detention Inspectorate, as well as the violation of the obligation to report the cases of torture by doctors, despite the effort to trans- pose into the national legislation of the Republic of Moldova the international standards in the field. The presence of these violations determines the necessity of the development of the complex mechanisms that would increase the efficiency of the practical implementation of guarantees regarding the non-application of torture in the domestic legal system.Item GARANŢII PROCEDURALE DE PROTECŢIE A DATELOR CU CARACTER PERSONAL ÎN CADRUL MĂSURILOR SPECIALE DE INVESTIGAŢIE(CEP USM, 2021) Cristea, DanielThe application of the general limitations of fundamental rights to data protection pursuant to Article 52, paragraph 1 of the EU Charter of Fundamental Rights, has raised interesting questions. According to this provision, limitations must be provided for by law, must return to the essence of the law concerned and, subject to the principle of proportionality, must be necessary and genuinely meet the general interest objectives recognized by the European Union or the need to protect the rights and the freedoms of others. We ask ourselves the question, can these limitations justify the unfair processing of personal data or the processing for purposes not covered by the legal basis for the collection, storage and disclosure of personal information at this stage of the prosecution under special investigative measures? În primul rând, trebuie să existe o bănuială rezonabilă că persoana a săvârșit o infracțiune, precum și existența riscurilor lăsării persoanei în libertate. De asemenea, cel reținut trebuie adus de îndată înaintea unui judecător și are dreptul de a fi judecat într-un termen rezonabil sau eliberat în cursul procedurii. Din păcate, exigențele nu sunt întotdeauna respectate, iar în multe situații, fapt constatat de către Curtea Europeană, judecătorii argumentează aplicarea acestei măsuri limitându-se la parafrazarea motivelor legale pentru arestare, fără a explica cum se aplică speței și fără a examina oportunitatea aplicăriii unor măsuri alternative mai puțin intruzive.
