Item THE TRANSFORMATION OF THE PARADIGM OF THE CONCEPT OF SOVEREIGNTY(2023) Slusarenco, Svetlana; Pozneacova, VeronicaThe concept of sovereignty represents one of the most important concepts within the framework of modern constitutional law, on which is focused the entire system of State power. The concept of sovereignty appeared in Ancient Greece and later was developed and analyzed by thinkers of the Middle Ages and the modern era. One group of the philosophers formulated the concept of papal sovereignty, believing that state power belongs to the Pope of Rome. Others analyzed the concept of royal sovereignty, stating that all state power should be concentrated in the hands of the king and, thus, personify state power. During the Enlightenment and the French Revolution, the philosophers justified the concepts of popular and national sovereignty. As a result of this research, we aimed to analyze the development of sovereignty from the philosophical point of view, as well as the practical applicability of the theories of great thinkers in the modern period.Item RAȚIUNI ALE RE-CONSTITUȚIONALIZĂRII DEMOCRAȚIEI ȘI A VALORILOR DEMOCRATICE(CEP USM, 2024) Ciobanu, RodicaThis article, synthetically, discusses the issue of consolidating democracy through the identification of essential challenges to current political and legal institutions that call for action. In this regard, the separation of powers and the need to strengthen the mechanisms for ensuring compliance with the rule of law, including through specific examples such as political corruption, lack of integrity, etc. Indirectly, it suggests the major role of the constitutional authority in ensuring the reform and consolidation of democracy in the Republic of Moldova and increasing citizens confidence in fundamental constitutional values.Item THE IMPACT OF COVID-19 ON THE RELATIONSHIP BETWEEN GOVERNANCE AND SOCIETY: EVIDENCE FROM AN ONLINE SURVEY(2021) Ciobanu, Rodica; Roșca, MarianaIn order to understand the impact of the COVID-19 pandemic on the relationship between governance and society, we surveyed approximately 500 Moldovans using an online instrument designed to recover the causal impact of the pandemic on the relationship between Moldovan citizens, the current governance and expected outcomes. Results show large negative effects across many dimensions. The article highlights how the relationship between government and citizens developed during the pandemic and underlines some vulnerabilities of Moldovan society which were also present before COVID-19, but intensified during the crisis. Due to COVID-19, 41,5% of Moldovans have changed their lifestyle and 88,4% argue that their situation is worst due to the fact that the pandemic crisis deepened the previous social, political and economic crises of the country. Finally, 35.4% of respondents point out to quite high levels of inefficient communication as well as contradictory information of governmental institutions and 75,5% consider there is a persisting lack of transparency in governmental communication during the pandemic crisis. Thus, we show that the economic and health-related shocks induced by COVID-19 expanded systematically on the society as a whole, with large negative effects on the relationship between governance and society.Item CRIZA PANDEMICĂ, UN IMBOLD PENTRU MODERNIZAREA SOCIETĂȚII MOLDOVENEȘTI(2021) Ciobanu, RodicaThe social order and stability, security and well-being have become essential in the context of the pandemic crisis, highlighting many social and human issues. This article, focusing on the identification of governance mechanisms for the protection of human rights, emphasizes the weaknesses shaped by the pandemic crisis and argues in favor of the need to modernize the Moldovan society. With the assessment of the social-human impact of the pandemic as main objective, the theoretical-methodological framework of synergetics has been used, enabling to deal with the problem within the conceptual, functional, and operational frameworks.Item THEORETICAL-METHODOLOGICAL FUNDAMENTALS OF ANALYSIS OF HUMAN RIGHTS GOVERNANCE(2019) Ciobanu, RodicaThis article deals with the essential dimensions in which theoretical approaches are carried out, as well as the methodological ones of government research in relation to the processes of modernization and democratization of societies, with priority given to the protection of human rights. Considered an essential dimension of contemporaneity, democratization cannot be treated outside government. That is why the basic sources used outline the common areas of analysis and circumscription of social and state realities in the direction of facilitating the transition process to the standards of good governance. Thus, through the scientific discourse of the government focused on the protection of human rights, the aim is to identify long-term solutions in order to establish in the conditions of the Republic of Moldova good practices in the person-state-law relationship.Item DREPTUL ŞI DREPTURILE OMULUI PE TIMP DE CRIZĂ: O ECUAȚIE CU MULTIPLE NECUNOSCUTE(CEP USM, 2021-12-08) Ciobanu, RodicaToday, human rights, the rule of law, and crises have increasingly become topics of discussion in the public, professional and scientific arenas. In this article, an interdis- ciplinary methodological perspective is used to analyze and understand modern crisis phenomena and how it is possible to make the transition from normality to the preser- vation and conservation of the value foundations of pre-crisis societies. Furthermore, the article offers some answers, from the author’s perspective, on how the crisis shapes law and rights, but also through constructive approaches offers some possible answers for the transition and the modernization of governance.Item IMPACTUL E-GUVERNĂRII ASUPRA ACTIVITĂȚII AUTORITĂȚILOR PUBLICE LOCALE(CEP USM, 2023) Slusarenco, SvetlanaThe use of information technologies represented a window of opportunity for local authorities to increase initiatives and tools for citizens’ participation and interaction with society. The goal of e-government is to strengthen democracy, which is achieved by guaranteeing citizens’ access to official information, streamlining the activity of public administration, increasing the quality level of public services, increasing the degree of participation of citizens in the governance process. In order to accelerate the development of services offered through electronic government, public authorities must be open to the computerization and technology of public institutions, as well as the inclusion of all social categories as beneficiaries of e-government services.Item CONDIȚII DE MODERNIZARE A GUVERNĂRII AXATE PE PROTECȚIA DREPTURILOR OMULUI ÎN REPUBLICA MOLDOVA(Tipografia Artpoligraf, 2021) Ciobanu, RodicaThe article analyzes the needed benchmarks to modernize the governance in the Republic of Moldova aimed at protecting human rights through a dual perspective: of the current standards of governance, especially the respect for the rule of law and the citizens’ requests for the governmental body and their consent.
