Item DREPTUL LA RESPECTAREA VIEȚII PRIVATE ÎN CADRUL PROCEDURILOR PENALE(CEP USM, 2021-12-08) Carajeleascov, CristinaThe priority of each state of law is to guarantee the observance of the right to inviola- bility of the privacy of every person under its jurisdiction. Due to the fact that the privacy right is not an absolute right, both national and international normative acts allow the interference of state authorities under exhaustive conditions provided by law that directly contribute to the achievement of the purpose of criminal proceedings. During criminal proceedings, the investigating judge is in charge of the supervision of the observance of human rights when carrying out criminal prosecution actions adversely affecting the ri- ghts of the persons involved. The importance of judicial control is outlined by the fair, equidistant and objective assessment of the acceptance of the interference in terms of its proportionality compared to the aim pursued.Item SOLICITAREA DE CATRE APARATOR A OPINIEI SPECIALISTULUI PENTRU EXPLICAREA CHESTIUNILOR CARE NECESITĂ CUNOŞTINŢE SPECIALE(Institutul Naţional al Justiţiei, 2020) Ceachir, AnatolAcordând asistenţă juridică calificată clientului, apărătorul trebuie să-şi îndeplinească cinstit, conştiincios, cu bună-voinţă, principial şi la momentul oportun propriile obligaţiuni în vederea promovării interesului celui acuzat. Din acest considerent, figurând în calitate de subiect al strângerii probelor, avocatul este obligat, în caz de necesitate, să antreneze specialistul în vederea obţinerii de consultaţii asupra oricăror chestiuni care apar pe durata desfăşurării procesului penal, lămurirea cărora necesită cunoştinţe speciale. Starting with the first contact of the child with criminal justice system until the pronunciation of the decision by the Court, including the enforcement of the punishment, the juvenile must be supervised by qualified profes- sionals from criminal justice system, who could intervene in each moment with a purpose of providing pertinent information to criminal investigative body and to the Court, in order to establish a proportionate and equitable punishment.Item BEST INTERESTS OF THE CHILD FOR CHILDREN IN CONTACT WITH THE LAW. VICTIMS AND WITNESSES(CEP USM, 2015) Bolocan-Holban, AugustinaFrom the moment a child victim/witness comes into contact with the justice system, he/she should be fully informed about the process they may have to go through as this can reduce any feelings of insecurity or anxiety that the child may have. Knowing when and where they will be interviewed and who by, how the justice process works, when they will be required to testify, who will be present, and the protection measures available for them both at an initial interview and when giving their testimony can have a positive impact on the quality of the statement they make. Providing a child with information can empower the child and allow him or her to feel more in control of an unfamiliar situation
