    Crizele economico-financiare atestate în ultimii ani a determinat multe întreprinderi să se confrunte cu problem de insolvenţă dar şi faliment. Falimentul reprezintă o procedură aplicată debitorului în vederea lichidării patrimoniului acestuia pentru satisfacerea creanţelor creditorilor, urmată de radierea debitorului, deci a întreprinderii.

    ETAPĂ DECISIVĂ PENTRU DEBITORUL AFLAT ÎN PROCEDURA DE INSOLVABILITATE

    The article describes the opening of insolvency proceedings or demand acceptance in principle of insolvency, the debtor through a period of observation. In this stage will decide the path that goes debtor either in restructuring accelerated procedure or the procedure itself restructuring in bankruptcy or liquidation through bankruptcy simplified procedure. The regulation into national law by reference to other legal systems, the duration of the observation period and the effects or measures that can be taken during this period are extremely important for the future insolvent debtor.

    This paperis devoted to the legal-penal analysis of the offenses underart.252"Intentionalinsolvency" and art.253"Fictitious insolvency" of the Penal Code. The analysis isperformed through the view of a new adopted law regulatingthe legal frameworkon insolvency. For this purpose,there were subjected to investigation:the special legal object; the material object;the victim; the content of the prejudicial act(of action or inaction);the prejudicial consequences and the causal next to; the offence circumstances; the moment of consumption of the offence;the form and type ofguilt; the offence motive and purpose;the general and special features of the subject of the offence;the aggravating circumstances. The interpretation of the concepts and terms that appear in art.252 and 253PCRM is importantto the successful implementation of these normsin the legal practice and for further development of scientific concepts.
