    Actele juridice încheiate cu condiţie constituie prin sine o construcţie complexă, care este orientată spre crearea unor drepturi şi obligaţiuni condiţionate, iar realizarea reală a drepturilor şi executarea nemijlocită a obligaţiilor, precum şi stingerea acestora se află într-o legătură indisolubilă de producerea unui eveniment viitor şi posibil. În cadrul formării actelor juridice încheiate cu condiţie, este dominantă inţiativa personală a părţilor, fapt ce determină individualizarea raportului juridic contractual. Acest fapt însă trebuie corelat pe principiu echitabil cu principiul securităţii circuitului civil.

    The present study is aimed at the ineffectiveness of the civil legal act, known in different states and as inefficiency. Because the doctrine has cataloged many of the cases of invalidity of the civil legal act to those of inefficiency, thus causing the legislator to make changes in the legislation, the present study offers a description of these aspects from a critical view.

    FORMA AUTENTICĂ: NECESITĂȚILE POPORULUI ȘI TENDINȚELE LEGISLATIVE ÎN REPUBLICA MOLDOVA

    The present article is dedicated to the examination of the authentic form of the legal (juridical) act. The notary authentication of a legal document has an enormous importance in the contemporary society, while had not fully explored its potential in the Republic of Moldova. In this context, the article contains as problems, as proposals for their resolution, including the ones related to the role of the notary during the authentication procedure and the effects of the failure to respect the authentic form.
