    SIGURANȚA CETĂȚENILOR ÎN CONTEXTUL COVID- 19 GARANTATĂ DE LEGISLAȚIA CONTRAVENȚIONALĂ: STUDIU DE CAZ

    The article revealed a case study on the safety of citizens in the context of Covid-19 guaranteed by the contravention legislation. In this context, we referred to the issues con- cerning the competence of the institutions to provide solutions to combat the pandemic, but we also examined what things have been done so far in solving this problem. The investigations used materials provided by the decisions, the reports that are in force, but also the information from the media, with real examples. At the same time, the legal analysis of the contraventions that are applied was per- formed, in terms of the contituent elements. And to eliminate the problems, we also exem- plified some more active enterprise measures to integrate information and communicati- on technology in the processes of governance, to inform the public more efficiently and to improve the accessibility of the information provided.

    DREPTURILE OMULUI IN CONTEXTUL ACTUAL

    In this article I chose to speak about the human rights which are being trampled on all over the world. At the end of this article I would like to make known a case which as- tonished everybody, being one of the biggest failures of Romanian Justice. It is about the Tundrea case, the man who stood behind bars for over a decade, altough being inocent. If we look around us, in the enviroments in which we conduct our daily activities, when we leave the house, regardless of the destination, being that to work, to school, to Church etc and while looking around we ask ourselves: What do we see? And by what are we surrounded? We will arrive to the conclusion that we are surrounded by rights: the right to live, to health care, the right to learn, to defend yourself, the right to believe and follow any religion, to work, the right to freedom, the right to mental and physical inte- grity, the right to information, all of them being mentioned in the Constitution at Chapter II Fundamental Rights and Liberties. We are also surrounded by liberties: Individual liberty, liberty of conscience and the freedom of speech, the last being restricted to a certain amount along with the right to freely express your toughts, beliefs and opinions which should have been sacred, unfor- tunately we can no longer benefit from them as they are being restricted due to this virus called Covid-19.

    PARTICIPAREA CIVILĂ ÎN PROCESE DECIZIONALE DE MEDIU ÎN CONTEXTUL CRIZEI DECLANȘATE DE COVID -19

    Public involvement or citizen engagement can be thought of as the processes that ensure the sentiments / position of citizens and non-governmental organizations are reflected in the way a authorities operate. More formally, the United Nations Department of Economic and Social Affairs defines public participation „the involvement of citizens in the decision making process of the State - through measures and / or institutional arrangements -to increase their influence on public policies and programs, ensuring a more positive impact on their social and economic levels”. The 2020 will remain in history as year of global pandemic with strong restrictions. Most Governments have responded to the coronavirus disease (COVID-19) pandemic by declaring a state of emergency and by adopting numerous measures to combat the spread of the virus, which have often included restrictions on the freedoms of assembly and movement. It is important to realized that the fundamental environmental rights should be respected and state should create and elaborate the adequate mechanism for guaranteeing the right to access to information and public participation in decision making process on environmental matters.

    RESTRICȚIONAREA UNOR DREPTURI ALE CETĂȚENILOR ÎN PERIOADA STĂRII DE URGENȚĂ

    The Parliament of the Republic of Moldova has the power to declare a state of emergency, siege and war. During a state of emergency, siege or war, depending on the gravity of the situation which led to its establishment, may be restricted, if necessary, to the euercise of the rights or freedoms of citizens in accordance with article 54 of the Constitution. With regard to the restriction of certain rights, the principle of proportionality must be taken into account, according to which any measure taken must be appropriate, necessary and proportionate.

    APLICAREA LEGISLAȚIEI CONCURENȚIALE ÎN TIMPUL PANDEMIEI

    Respectarea legislației concurențiale este indispensabilă pentru o economie puternică, inclusiv în cazurile declarăriiunei pandemii sau instituirii stăriide urgențe de către unele state. Măsurile luate de către unele state, cum ar fi închiderea frontierelor, interzicerea exporturilor unor produse (măști medicale, dezinfectante etc.), suspendarea activității unor agenți economici,afectează direct sectoare întregi din economia națională.Respectiv,agenții economici sunt nevoiți să ia unele măsuri care ar putea afecta concurența pe o perioadă restrânsă de timp, însă efectele pot fi de durată.Prezentul articol cuprinde analiza măsurilor anunțate de către autoritățile de concurență din diferite state cu privire la aplicarea normelor din domeniul concurenței în situația de pandemie.
