    Possibility of incurring legal liability, be it disciplinary, criminal or civil, of the judge is not contrary to international standards, especially in case of violation of the mandatory norms, even more it is necessary in a democratic society. At the same time, according to international standards, disciplinary procedures regarding judges must be accompanied by certain guarantees to prevent interference in the independence of the judicial system. In this article, we propose to analyze in the light of the jurisprudence of the European Court of Human Rights the basic principles of disciplinary liability of judges.

    HOTĂRÂRILE CtEDO: OBLIGATIVITATEA EXECUTĂRII LOR DE CĂTRE AUTORITATEA JUDICIARĂ NAŢIONALĂ

    În prezentul articol este cercetat conceptul executării hotărârilor CtEDO de către autoritatea naţională judiciară cu definitivarea raţionamentelor de aplicare a precedentului judiciar în cadrul procesului penal. Totodată, au fost abordate premisele de utilizare a jurisprudenţei ca izvor de drept în cadrul procesului penal cu relevarea particularităţilor executării hotărârilor CtEDO în cadrul procesului penal. Prin cercetarea efectuată a fost realizată o investigaţie complexă a aspectelor teoretico-legislative privind executarea hotărârilor CtEDO în cadrul procesului penal în calitate de izvor de drept. În lucrare sunt formulate concluzii şi recomandări care pot constitui un fundament ştiinţific pentru eventuale modificări legislative. În prezentul studiu a fost identificat rolul Curţii Europene şi al Consiliului Europei în vederea asigurării executării şi respectării hotărârilor CtEDO de către autorităţile judiciare naţionale. De asemenea, studiul denotă rolul activ al puterii judecătoreşti în procesul implementării şi executării hotărârilor Curţii Europene în Republica Moldova.

    NATURA JURIDICĂ A CONTRAVENȚIILOR DIN PERSPECTIVA CURȚII EUROPENE A DREPTURILOR OMULUI

    The applicability of the European Convention on Human Rights to contraventions is controversial. The „Engel criteria”, firstly issued in the Case of Engel and others v. the Netherlands (8 June 1976), are used by the European Court of Human Rights to explain if it has jurisdiction and if the case is of „criminal matter” in its own view.Through this scientific article we intend to study the „Engel criteria” and therefore to explain why cases of contravention matter can be examined by the European Court of Human Rights and what is the judicial nature of contraventions from the perspective of the European Court of Human Rights.

    The purpose of this study is to examine the aspects of the quality requirements of normative acts in the field of legal liability of judges and compliance of national legislation with the principles of clarity and predictability of the law in the light of ECHR case law. In this context, were examined the provisions of the European doctrine and the approaches set out in the jurisprudence of the European Court of Human Rights regarding the requirements of the law, the definition of the concepts of accessibility, clarity, predictability and preeminence of law, as well the guarantees to be established by the legislator in case which the legal norm brings the violation of fundamental human rights.

    The European Convention on Human Rights is a tool for the protection of human rights. The text of the Convention cannot be interpreted separately from its jurisprudence, which evolves continuously and is appreciated for its value, its pontential to consolidate protection and to exclude abusive practices regarding the fundamental human rights and liberties guaranteed by the Convention.

    JURISPRUDENŢA CURŢII EUROPENE A DREPTURILOR OMULUI PRIVIND PROTECŢIA DATELOR CU CARACTER PERSONAL ŞI VIAŢA PRIVATE

    The jurisprudence of the european court of human rights, regarding the protection ofpersonal dataandthat ofprivate life highlightsrelevant practical aspects of the constitution of evidence and the use of specific arguments in the ECHR. For instance, concerning the approach used to solve cases from this field, the jurisprudence of the European Court of Justice is also important, serving as a model for the jurisprudence of ECHR. The jurisprudence of ECJ is appreciated and respectively, recommended as an example of good practice. We, thus, acknowledge the possibility to consolidate the protection in the above-mentioned field and to exclude the abusive practices by using jurisprudence and comparative strategies. The cases from the judiciary practice of a certain country or judicial system can be valuable to other countries, including the Republic of Moldova, by presenting effective judiciary solutions. ECHR is the authority responsible of interpreting the Convention of Human Rights,the two of them representing a whole.
