    Tradiţia constituţională şi inovaţia legislativă: un echilibru necesar [Articol]

    The article discusses the importance of maintaining the balance between the preservation of constitutional tradition and the adaptation of legislation to contemporary circumstances. It analyzes how the past, the present, and the future merge into a formula that expresses the modern spirit and emphasizes the role and importance of the Constitutional Court and the Constitution. To accomplish the proposed aim, a review of criticized decisions has been made, which reinforces the argument of the balance between tradition and innovation in modern society. The Constitutional Court is often criticized for the way in which it interprets and applies the fundamental law, with decisions of the Court sometimes seen as failing to respond to the dynamic needs of the society. The article also examines the tensions between the preservation of traditional constitutional values and the need for legislative changes to reflect socio-political shifts. The content of the article reflects the convergence of tradition and innovation, which needs to be valorized through both research and practice (of judges, lawyers, prosecutors, etc.), indicating a combined effort and a transversal perspective of theoretical and practical evaluation of the topics that are the center of attention in ensuring legal safety in a constantly changing world, while not compromising constitutional stability.

    The content of this article formulates questions on the wide reform processes that the Republic of Moldova has gone through in the context of its reform and modernization initiatives. The questions addressed outline some processes and reasons that reveal potential directions of analysis and propose solutions in order to maintain progress towards good governance, protection of the individual, and efficiency of law. In this context, the law is seen as an instrument capable of contributing to socio-political stability and responding to the challenges of digitization and globalization.

    During the last period, more and more companies as well as state institutions trend to optimize and digitalize their activities by developing and implementing new informational systems, programs, softs, etc. However, not all the time, legal aspects are well considered. Therefore, hereby article, relieve the most important legal aspects which should be considered in the context of the development and deployment of the new technologies. This paper examines steps which should be performed by interested in development bodies, as well, as presents detailed information related to the ethical aspects which should be considered in context of the development of new technologies.

    Tehnologiile – cadru de dezvoltare pentru domeniul juridic [Articol]

    Given the technological developments of the last 50 years, we are certain that these years will go down in history as a period characterized by the evolution of information technology. During this time appeared the concept of capitalizing on information and Internet, new tools, mechanisms, and even algorithms for processing of information were developed and implemented. Society not only creates information, but is dependent on information, or this element of the new reality feeds the functional context of the organizational processes of the new society. Thus, this article proposes to address the regulatory context and the framework of actions needed to be taken from the perspective of relating the new reality to the usual living environment.
