    Necesitatea şi limitele reglementării constituţionale a administraţiei publice [Articol]

    The Constitution of the Republic of Moldova, as well as the constitutions of other democratic states, includes a number of provisions applicable to public administration. In this study are presented the constitutional provisions on administrative authorities and their activity, as well as the arguments justifying the need and importance of constitutional regulation of public administration. The constitutional text cannot include detailed provisions on public administration because it is an area that is constantly changing. Thus, in the Constitution of the Republic of Moldova we find only fundamental rules, basic ideas and principles, but the details related to the organization and func- tioning of administrative authorities are set out in laws and acts subordinated to laws.

    Prezentul articol constituie un studiu dedicat diverselor tipuri de guverne existente în țările contemporane. Scopul acestui articol este de a analiza normele constituționale referitoare la formarea și încetarea activității guvernului, structura și componența acestuia în diverse state și de a descrie rolul guvernului într-o societate contemporană. Studierea comparată a instiuției guvernului ne permite să concluzionăm că nu există un model unic de organizare și funcționare a acestei autorități publice, reglementările juridice în domeniul dat fiind diferite de la un stat la altul.

    Responsabilitatea ministerială: de la abordări istorice la realități contemporane [Articol]

    The responsibility of the executive power is an essential condition of democracy and the rule of law. In the Romanian space, for the first time, the principle of ministerial responsibility was enshrined in the Organic Regulation of 1832, applied in Muntenia and Moldova. The Constitution of Romania from 1866 expressly and in detail regulates the responsibility of ministers, establishing that each of the two Chambers of the Parliament (the Senate or the Chamber of Deputies) or the Lord can accuse the ministers and send them to the High Court of Cassation and Justice for to be judged. We also find the idea of ministerial responsibility in the Constitution of Romania from 1923. The current Constitution of Romania, in art. 109, establishes two categories of liability, namely: a political liability of the Government before the Parliament and a criminal or civil legal liability.

    Locul și rolul Președintelui Republicii Moldova și Președintelui României în sistemul autorităților publice [Articol]

    Instituția șefului de stat constituie obiect de cercetare atăt pentru știința dreptului constituțional, căt și pentru știința dreptului administrativ. Articolul este consacrat examinării, în plan comparativ, a rolului și locului șefului de stat în sistemul autorităților publice din Republica Moldova și România. Sunt analizate prevederile constituționale ce determină funcțiile și atribuțiile Președintelui Republicii Moldova și Președintelui României, opiniile expuse în doctrină, precum și jurisprudența constituțională în materie. Analiza comparativă ne permite să evidențiem care sunt trăsăturile comune, dar și diferențele dintre statutul juridic al Președintelui în aceste state. În opinia autorului, la nivelul Șefului de Stat sau ale Guvernului orice atribuție politică duce la un subsidiar administrativ și orice atribuție administrativă are un substrat politic, încât o delimitare între „politic” și „administrativ” apare ca fiind riscantă și didactic nerecomandabilă. În concluzie, autorul argumentează ideea necesității redefinirii rolului și locului Președintelui Republicii Moldova în sistemul autorităților publice, prin regândirea cadrului constituțional în vederea instaurării unui regim semiprezidențial după modelul României sau cel al Franței.

    The normative and values dilemmas related to the government-citizen relationship during the pandemic [Articol]

    The article outlines a part of the research findings carried out using a complex methodological framework, designed to assess the current social context of the Republic of Moldova, and aims to identify the governance modernization challenges. It reflects the assessment of the relationship between authorities and citizens during the pandemic crisis and demonstrates the relevance of value-normative foundations for the social construction. The preference for interdisciplinary methodology facilitated the structuring of the research in several basic compartments: the first one reflects in a synthetic formula the theoretical-methodological framework of analysis and the formulation of the working hypothesis, followed by the substantiation and support of the authors' positions on the basis of pragmatic and normative-value arguments, and concluded with generalizations that provide a platform for scientific debate with a view to pursuing further approaches on the subject of the impact of crises on the social framework and the need for spiritual foundations in human perpetuation. © 2021 PROUniversitaria Publishing House.
