From a practical point of wiew, court sentences on criminal cases resolved in national courts on criminal cases resolved in national courts were studied: 11 practical cases that were examined and are still being examined under the aspect of criminal law in the period 2016-2023.Item CYBERBULLYING: PROVOCARE SAU REALITATE?(CEP USM, 2022) Colțeniuc, Anatolie; Șaporda, EcaterinaCyberbullying or cyberharassment is a form of bullying or harassment using electronic means. Cyberbullying and cyberharassment are also known as online bullying. It has become increasingly common, especially among teenagers, as the digital sphere has expanded, and technology has advanced. The lack of specific regulations in the national criminal and contravention legislation makes it difficult to qualify cyberbullying and makes it almost impossible to hold people accountable for such acts. Following the analysis, some proposals of lege ferenda will be outlined, in order to adapt the national criminal / contravention legislation to the current conditions.Item PROTECȚIA JURIDICĂ A COPILULUI CONTRA VIOLENȚEI ÎN ȘCOALĂ: CADRUL NORMATIV AL REPUBLICII MOLDOVA VERSUS CEL AL ROMÂNIEI(CEP USM, 2022) Botnarenco, Mihaela; Gurev, DorinaIn the present scientific research, the normative framework of the Republic of Moldova and that of Romania regarding the protection of children against violence in general educational institutions (pre-university) is examined from a comparative point of view. The study does not reveal a comprehensive analysis of forms of school violence, its purpose being to review existing regulations in the field and to understand the trends of legislative policy in this area. It is concluded that in Romania the normative framework on the protection of children against school violence is more advanced, in comparison with that in the Republic of Moldova. However, in both states, the degree of legal protection cannot be considered appropriate to the extent of the phenomenon of school violence.
