    Libertatea de exprimare a mass-media în perioada electorală în jurisprudenţa Curţii Constituţionale a Republicii Moldova [Articol]

    Freedom of expression is a fundamental right and is an essential element of a democratic society. Freedom of the press gives the public a means to form an opinion on political ideas. The mass media has an important influence in contemporary society: it not only informs, but can suggest, through the way it presents information, how this information should be evaluated. These findings are also valid in the case of media coverage of the elections. During the electoral period, the mass media has the obligation to respect the principles of fairness, balance and impartiality in covering the elections, to inform the public correctly and objectively, to ensure equal opportunities for electoral competitors and a plurality of opinions that reflect the diversity of political opinions in the country.

    Instituția autodizolvării parlamentului. O soluție pentru Republica Moldova? [Articol]

    This article aims to provide an analysis of the dissolution mechanism by decision of Parliament as one of the constitutional tool for unblocking constitutional crises. Thus, the main objective is to analyse the opportunity to introduce the institution that allow the Parliament to vote for its own dissolution, thus enabling Parliament to decide whether it should dissolve itself before the end of its legal term. Another important component of the article is to describe the Constitutional Court of Moldova approach regarding this institution and the constitutional experience of the self dissolution mechanism of the Parliament in 1993.

    Aplicarea acquis-ului în jurisprudența unui stat non-membru al uniunii europene - cazul Republicii Moldova

    Aderarea la Uniunea Europeană implică respectarea democrației, drepturilor omului și a valorilor europene, precum și îndeplinirea criteriilor politice, economice și administrative. Consiliul European a aprobat deschiderea negocierilor de aderare cu Republica Moldova în decembrie 2023, iar aceasta trebuie să implementeze reforme extinse și să efectueze modificări ale legislației pentru a se alinia standardelor europene și acquis-ului Uniunii. În acest articol este reflectată și analizată jurisprudența națională dezvoltată de Curtea Constituțională și Curtea Supremă de Justiție în domeniul aplicării dreptului Uniunii Europene și a aderării la valorile acesteia. Deși aplicarea acquis-ului nu era o obligație a statului formal vorbind, având în vedere că nu este, deocamdată, membru al Uniunii Europene, acest fapt denotă, însă, direcția clară de integrare europeană a Republicii Moldova.

    Rolul jurisprudenței europene în justiția Constituțională din Republica Moldova [Articol]

    In the article, the authors analyze the application of the ECtHR jurisprudence in the CCRM (Constitutional Court of the Republic of Moldova)jurisprudence and its importance for the national constitutional jurisprudence. In particular, its application in the area of human rights has been examined. The impact of the ECtHR jurisprudence on other areas, such as gambling control, free competition, criminal matters, has also been analyzed. The authors determine that there is a growing trend in national jurisprudence in the application of the jurisprudence of the European Court of Human Rights and the Court of Justice of the European Union.

    Actele justiției constituționale: sunt sau nu acestea izvoare de drept? [Articol]

    The article contains a summary approach of the notion of source of law and of the categories of sources of law in order to assess the possibility of recognizing this quality in constitutional justice acts. As a result of the analysis carried out it is noted that there is no unique position on the vocation of these acts to be sources of law, which justifies the launch in the academic environment of extensive theoretical discussions in this field.

    Actul normativ și actul juridic individual [Articol]

    The correlation between the legal normative act and the individual legal act, at first sight, would be a quite frequently approached topic and would present a predominantly didactic interest and not a theoretical-practical one. Contemporary legal reality shows that the applicative interest and the impact on the mechanisms of protection of human rights, freedoms and public interests, in an area of good governance, ensured by the rule of law, manifested by the correlation and the clear determination in the legal doctrine of the correlation between the normative act and the individual legal act, obtains a new approach of an accentuated relevance. The clear appreciation of the normative or individual nature of the legal act develops the perspective of carrying out the judicial control of their constitutionality or legality, of the preliminary procedures necessary to be applied in exercising different forms of control, of the consequences of pronouncing a decision by a court and of issues generated by the enforcement of this decision. In these conditions, an elementary doctrinal subject obtains the status of an important field of theoretical - practical investigation, oriented towards the streamlining of the act of justice and to the observance of legality.

    This article aims to provide an analysis of the Constitutional Court jurisdiction in solving institutional conflicts between the Parliament and the President of the Republic concerning the designation and appointment of the Prime Minister. Thus, the main objective is to analyze the Constitutional Court approach regarding the insurance of the separation of powers principle between the legislative and presidential institution.
