    Particularities of the Model of Constitutional Justice Applicable in the Republic of Moldova

    This article intends to examine the evolution of the constitutional justice applicable in Republic of Moldova, with the establishment of the Constitutional court, analyzing the key differences between European model of Constitutional court and the mechanism created in the Republic of Moldova over the years, while focusing on the concrete Moldavian historical-political background which had an impact on the shaping of the Constitutional Court.

    Reglementări juridice comunitare cu privire la principiul transparenței

    Articolul dat vine să analizeze principiul transparenței din cadrul juridic al Uniunii Europene. Acesta se bazează pe valorile juridice bine stabilite, cum ar fi democrația și statul de drept, de aceea e destul de important a observa dinamica evoluției acestuia la nivel comunitar, odată ce Republica Moldova este un stat care aspiră să devină membră a comunității. La fel, principiul transparenței și al deschiderii sunt acele instrumente care permit Uniunii Europene să funcţioneze în mod eficient. La momentul actual, Uniunea Europeană a devenit mai mult decât o asociere economică, astfel, principiul transparenței trebuie să funcționeaze ca un principiu de bază în procesul de luare a deciziilor în cadrul Uniunii. Orice cetăţean al UE trebuie să fie informat despre posibilităţile şi drepturile în legătură cu primirea informaţiei necesare pentru a-şi proteja drepturile sale. Transparenţa serveşte ca un instrument ce oferă posibilitate cetăţenilor să fie mai implicaţi în procesul decizional şi asigură legalitatea şi eficienţa administrării în sistemul democratic, precum şi defineşte nivelul înalt de responsabilitate al UE faţă de cetăţeni.

    Societatea civilă ca formă specifică de organizare a relaţiilor sociale [Articol]

    By contacting with all socio-political and socio-economical phenomena, civil society issue is present almost in all domains, being linked with all social life's areas - philosophical, social, economic, political, legal etc. Civil society is one of the 3 drivers, on which are based democratic society and may solve efficiently a set of problems. Of course, such a desideratum is actual even for the new democracies. The problem of building a state of law and of a civil society, as well as the mechanism of interaction between these two concepts, presents, at first glance, a purely academic interest for Moldova at the moment. In fact, it is one of the most important not only for the country’s socio-political development, but also for its future. Covering the socio-cultural space between the individual and the state, the civil society is regarded as a decisive factor of success and failure in the consolidation of democracy, as well as, implicitly, in the rule of law in Moldova.

    STATUL DE DREPT: ÎNTRE LEGISPRUDENȚĂ ȘI JURISPRUDENȚĂ

    The term „legisprudenţă” came recently in legal vocabulary, and refers to the legislative work. Social reality is pressuring the legislature to arrive at appropriate ways of regulating social relations. Jurisprudence its results contribute to the formation and consolidation of a legal system that meet society’s expectations and participate in training, a state of law. To that end between the compilers and applying the right must be a permanent connection (directly and/or through science), which in this article is illustrated by the examples of constitutional and european jurisprudence.Legisprudenta is rational theory of legislation, which is to develop the idea of freedom as a principle. giving the legislator the possibility to exceed the jurisprudence, to create something new. However, a rule is coming as an innovation, but this is not always properly understood and applied, leaving room for interpretation, which complicates the legal qualification. Thus, the outcome of the application and its legal qualification. preceded by actions of the interprets the rule, and the assessment capacity and anticipate of the possible evolutions of social relations as reflected in normative-legal text, approved by the legislature.

    The article deals with the identification of definitory features of governing regime and analysis all its types. This, in the doctrine there are presented the following types of governing regime, in dependence of distribution of power functions between political institutions and on before who the executive is politically responsible: presidential regime, parliamentary regime, semipresidential regime and semiparliamentary regime.

    CONSIDERAȚII TEORETICE PRIVIND GUVERNAREA, REGIMUL POLITIC ȘI REGIMUL DE GUVERNARE

    This article deals with definition and analysis of the core concepts of a democratic regime. These concepts are: governance, regime, parliamentarism, presidentialism, state power separation, governing regime and its consolidation. The concept of governing regime is a new one and starts from a classification of political regime. This classification is ambiguous and many scholars make confusions between the concepts. That is why this article comes into explaining this notion by simplifying and excluding the confusions in this domain. The article ends with personal definition of the governing regime that is a system of organization and exertion of state power through which is realized the distribution of power between different categories of bodies and that ensures the independence, collaboration and reciprocal control of political institutions.
