    At all times of the entrepreneurs’ economic activity, could be generated situations when the person, as a result of certain circumstances, either objective or resulted from personal negligence, remains unable, either absolute or temporary, to satisfy its creditors. Normally in such situations the main protagonist is the debtor of the trade relation, in connection with whose special situation, a specific procedural position is get in insolvency proceedings.

    Importanța și conținutul termenelor în procesul civil

    Termenul de procedură constituie acel interval de timp înăuntrul căruia trebuie îndeplinite acte de procedură. Pentru procesul de înfăptuire a justiției, termenele de procedură au o semnificație primordială, dat fiind faptul că aceasta reprezintă nu numai o formă de organizare a procesului civil în dimensiunea timpului, dar și o condiție de valabilitate a actelor de procedură. Astfel, aplicarea termenelor de procedură reprezintă nu doar o sarcină a procesului civil, ci și o garanție a unui proces echitabil. Iar cunoașterea esenței termenelor de procedură reprezintă chezășia unui act judecătoresc întemeiat și legal.

Această idee a fost şi este admisă de literatura de specialitate, de regulă, cu precizarea că autoritatea lucrului judecat a hotărarii defi nitive are caracter provizoriu şi se va consolida sau, dimpotrivă, se va desfi inţa, in funcţie de soluţia dată in ordinea exercitării căilor de atac.

    La politique europeenne de voisinage: etude de cas - la Moldavie le partenaire de l'union europeenne

    The European Union (EU) is a community of states, based on the principles of freedom, democracy, respect for human rights and rule of law. So far, EU experienced several enlargement stages, within which the accession of new Member States was possible. As a result of the last expansion stage, since the 1st of July 2013, EU has grown to 28 Member States. Despite the debt crises and the difficult years, with unsolved issues within the EU, generally speaking, and within the Monetary Union, particularly, EU remains the most important pole of attraction for its neighbours. This appears to be true based on their persistent attitude concerning the process of European integration. The main reasoning behind the willingness of these states to accede the EU are: free access to EU market, free movement of persons, as well as the possibility to make use of the European legislation devised by the EU institutions. Instead, the Member States acquire more competitiveness in the world market, as EU, in its entirety, will be able to compete with the most important actors of the world economy, such as China, India, Brazil, etc. After the „big-bang” enlargement process of 2004 and 2007, the EU external policy faces a dilemma: how it would be possible to promote the objectives of peace, prosperity and good governance in the neighbour countries, without an enlargement perspective? The European Neighbourhood Policy (ENP) – launched in 2003, applied in 2004, had as an objective to develop a space of prosperity and stability towards the Southern and Eastern neighbours, without the valuable promise of membership. The unique framework was nothing else, but a tool for placing the neighbouring countries in one bunch, re-united and required to share everything, except the European institutions. It was not long before EU acknowledged the need to distinguish between the South and Eastern Partners and the need to establish a different approach for the two, which would allow a better response to their individual needs and ambitions. The Eastern Partnership, as response to the Union for the Mediterranean, launched in 2008 and promoted in 2009 by Poland and Sweden, recognizes a fundamental element for the EU Eastern neighbours: their „Europeanness”. This article is aiming at presenting the Eastern dimension of the ENP, which comprises the states from East (Ukraine, Moldova and Belorussia) and the states from Southern Caucasus (Armenia, Georgia and Azerbaijan), with a particular focus on the Republic of Moldova’s status in its relations with EU. Currently, these states have an important place within the framework of the EU’s international strategy.

    Consecinţele neexecutării actului jurisdicţional internaţional

    Non execution of judgments delivered by the International Court of Justice represents a distinct gravity because it refers to the sensible question of court’s efficiency. As a general rule, states are obliged to execute the provisions settled in the judgments held by the ICJ. Though the non-execution can be justified through the point of view of practical international relationships, it can never be excused from the perspective of international public law from mere point of view that a refusal to execute a final boundary decision is a violation of law and engages the responsibility of the culpable state.

    Interzicerea armei nucleare – o sarcină primordială a lumii contemporane

    The nuclear weapons ban represents a stringent task in the today world. There are still sufficient states which support the necessity of nuclear weapons possessing in order to guarantee and assure international peace and security, this fact not corresponding any more to the situation we presently face. In a world where nuclear energy is used also in non peaceful goal, there cannot be safety and peace, atomic arms being a continuing danger for the mere existence of the mankind. The nuclear weapons ban is a complex process characterized by specific periods of adopting of different international imperatives acts, they being more than 10, which for more than half of century eager to stop the nuclear proliferation and to edify a world with no nuclear weapons. Well, till there are states concerned in maintaining of their nuclear power, the nuclear arms ban is more fictive than real.
