It is imminent and absolutely necessary for the state, concurrently with the delegation of certain powers that are eminently its responsibility, to establish efficient and flexible control mechanisms over the exercise of the delegated powers. Starting from this objective, the legislator intervened in the framework law that regulates the activity of bailiffs. Disciplinary procedures for bailiffs have recently been subject to legislative changes. The article presents the critical analysis of some aspects related to the modification of the grounds of admissibility of the notification addressed to the Disciplinary College of bailiffs.
The legal consequences of the application of the new regulations are also subject to analysis, including through the lens of the chances to continue examining referrals that do not belong to the competence of the Disciplinary Board in the competent court.
