This paperis devoted to the legal-penal analysis of the offenses
underart.252"Intentionalinsolvency" and art.253"Fictitious insolvency"
of the Penal Code. The analysis isperformed through the view of a new adopted law regulatingthe legal frameworkon insolvency.
For this purpose,there were subjected to investigation:the special legal object; the material object;the victim; the content of
the prejudicial act(of action or inaction);the prejudicial consequences and the causal next to; the offence circumstances; the moment of consumption of the offence;the form and type ofguilt; the
offence motive and purpose;the general and special features
of the subject of the offence;the aggravating circumstances.
The interpretation of the concepts and terms that appear in art.252
and 253PCRM is importantto the successful implementation
of these normsin the legal practice and for further development of
scientific concepts.
