    The status of a candidate country for joining the European Union is an opportunity for the Republic of Moldova to reflect on the progress achieved and to ensure our common commitment to improving and sharing common European values. Joining the European Union is an opportunity, but it is also a responsibility. With a view to joining the European Union and aligning the national regulatory framework with European standards regarding central and local public administration, numerous public policy acts were adopted, which describe the vision, purpose, objectives, actions and resources necessary for the process of transformation/improvement of public administration from the Republic of Moldova at central and local level. The process of adopting a new regulatory framework favors compliance actions at the national, local level.

    CONCEPTUL SUVERANITĂȚII POPORULUI DIN PERSPECTIVĂ ISTORICĂ

    Conceptul suveranității puterii de stat reprezintă un subiect de bază a întregii filosofii juridice, care s-a dezvoltat începând de la Antichitate și a triumfat în perioada Iluminismului. Conceptul suveranității populare reprezintă o doctrină dominantă în cadrul filosofiei juridice a secolelor XVII-XVIII. Ideea principală promovată de susținătorii acestei doctrine s-a axat pe poziționarea poporului, ca fiind deținătorul principal al puterii de stat, de la care emană voința supremă. În prezent, suveranitatea populară reprezintă baza puterii de stat, iar poporul este văzut ca unicul titular al puterii supreme, ceea ce reprezintă baza constituționalismului contemporan. Prezentul articol reprezintă un studiu dedicat cercetării aspectelor specifice ale conceptului suveranității populare în istoria ideilor. Interesul doctrinar și practic fața de conceptul suveranității populare se bazează pe dimensiunea politico-juridică a acestui concept în cadrul construcției statale. În prezenta cercetare ne-am pus drept scop determinarea rolul conceptului suveranității populare în cadrul constituțional actual, abordarea fiind axată pe analiza aspectelor filozofice a acestei doctrine.

    THE TRANSFORMATION OF THE PARADIGM OF THE CONCEPT OF SOVEREIGNTY

    The concept of sovereignty represents one of the most important concepts within the framework of modern constitutional law, on which is focused the entire system of State power. The concept of sovereignty appeared in Ancient Greece and later was developed and analyzed by thinkers of the Middle Ages and the modern era. One group of the philosophers formulated the concept of papal sovereignty, believing that state power belongs to the Pope of Rome. Others analyzed the concept of royal sovereignty, stating that all state power should be concentrated in the hands of the king and, thus, personify state power. During the Enlightenment and the French Revolution, the philosophers justified the concepts of popular and national sovereignty. As a result of this research, we aimed to analyze the development of sovereignty from the philosophical point of view, as well as the practical applicability of the theories of great thinkers in the modern period.

    ABORDĂRI CONCEPTUALE PRIVIND REORGANIZAREA UNITĂȚILOR ADMINISTRATIV-TERITORIALE DIN REPUBLICA MOLDOVA

    Transformările administrativ-teritoriale sunt determinate de declinul demografic, cauza fiind emigrarea masivă sau migrația în interiorul statului, de starea precară a infrastructurii și a economiei localităților respective. Numărul mic al populației per UAT limitează resursele financiare și, drept consecință , capacitatea instituțională și administrativă a APL de a-și îndeplini responsabilităț ile. În condițiile create, având în vedere faptul că unele dintre localitățile rurale au ramas fără locuitori sau au un numar foarte mic de locuitori, a fost lansată ideea de amalgamare a unităților administrativteritoriale. Reforma structurală sub forma fuziunii autorităților locale va modifica harta administrației locale. Această reformă, care inițial urmează să fie voluntară, amalgamează două sau mai multe autorități locale într-o nouă entitate organizațională politică și economică.

    FUNCŢIILE ȘI ATRIBUŢIILE PREȘEDINTELUI REPUBLICI MOLDOVA PRIN PRISMA JURISPRUDENŢEI CURŢII CONSTITUŢIONALE A REPUBLICII MOLDOVA

    The institution of the president, especially the person of the head of state, has played, since ancient times, the defining role in the organization and functioning of any collective/community. In the context of the importance of the institution of the head of state in the system of central public authorities, and also taking into account the political regime from the perspective of the need to ensure the separation of powers in the state, particular importance is given to the determination of the functions and the establishment of the powers of the President, which, in the end, conditions the legal nature of the political system and the constitutional configuration of government. The functions and powers of the President are determined by factors, such as: the way of appointing the head of state, the relations between the legislative and the executive power, the constitutional checks and balances mechanism to ensure the balance between the state institutions, namely: Parliament-Government, Parliament President, President-Government and in relation to the judicial authority.

    IMPLEMENTAREA ACORDULUI DE ASOCIERE REPUBLICA MOLDOVA – UNIUNEA EUROPEANĂ ÎN DOMENIUL CERCETĂRII

    In 2014, it was signed the Association Agreement between the Republic of Moldova and the EU. It provided the set of the complex measures that should be implemented in the Higher Education field. These measures refer to the standards of education’s evaluation, accreditation of educational programs, reform of the vocational and university education system, implementation of the lifelong learning concept, and implementation of international projects in education. Implementing the Association Agreement between the Republic of Moldova and the EU in education determined the adoption of several primary and secondary normative acts. We examined the National Action Plans for implementing the Association Agreement Moldova – EU in 2014-2016, 2017-2019, establishing the evolutions of the reforms in education. In this study, we aimed to determine the Association Agreement’s provisions in high education, to analyze the positive obligations assumed by the Republic of Moldova, and to examine the normative provisions by which our state realized these obligations.

    ROLUL ADMINISTRAȚIEI PUBLICE LOCALE PRIVIND GARANTAREA REALIZĂRII DREPTURILOR ȘI INTERESELOR COPIILOR

    In Moldova, there have been major developments regarding the protection of children's rights. A series of international documents have been signed and ratified, including those on the protection of children's rights, with national legislation largely adapted to international documents. at the central level, responsible for protecting the interests of children are the Ministry of Labor and Social Protection, the People's Advocate for children's rights and legal bodies, and at the local level, a wider spectrum of competent authorities in the defense of children's rights is proliferating. the central public authorities involved in the protection of children's rights have general powers, covering the entire spectrum of rights guaranteed to children, while the local public authorities responsible for realizing children's rights have a very narrow sphere of activity, mainly limited to assisting children who are in risk situations, participate in the drawing up of the act of abandonment of the child, the application of the procedure of taking the child from the parents or from the persons in whose care he is, if, as a result of the initial assessment, it is found that there is an imminent danger for the life or health of the child.

    GARANTAREA SIGURANȚEI PERSOANEI PRIN PRISMA ASIGURĂRII RESPECTAREA ORDINII ȘI SECURITĂȚII PUBLICE ÎN STAT

    The Republic of Moldova implements viable measures to guarantee the country's security and democratic development. Efforts are being made to increase the role of public authorities in the supervision of the activities of institutions in the security and defense sector. The safety of the person is a fundamental social value, the existence of which depends on the state's activity in carrying out its tasks and functions. The concept of safety must be approached, thus, as an essential collective right, closely related to other collective rights, such as social integration, the right to work, to health, to education and to culture. In this context, the safety of the person can be viewed, in general, under two aspects, namely: under the objective aspect and under the subjective aspect.

    ROLUL ADMINISTRAȚIEI PUBLICE LOCALE PRIVIND GESTIONAREA SITUAȚIEI MIGRANȚILOR

    The migration of people is determined by certain factors, sometimes negative, such as low employment, lack of security, poverty, war, which make people want to move to a new area, that is, forced migration occurs, or factors of attraction, i.e. those positive aspects that attract people to move to a place, for example, good employment opportunities, better services, political stability, safe society, less crime. With the start of military actions in Ukraine, especially Romania and Moldova became a place of refuge for the inhabitants of this state affected by the events in the country. Thus, a large number of Ukrainian migrants took refuge on the territory of the Republic of Moldova. The public authorities were determined to undertake urgent measures in order to integrate the Ukrainian immigrants who arrived in the Republic of Moldova.

    RESPECTAREA PRINCIPIULUI EGALITĂȚII PRIVIND INCLUZIUNEA SOCIALĂ PERSOANELOR CU DIZABILITĂȚI

    Discriminarea cu care se confruntă persoanele cu dizabilităţi se bazează pe prejudecăţi, atitudini, stereotipuri şi mituri. Conceptul de dizabilitate a evoluat pe parcursul istoriei atât ca conținut, cât și ca formă de exprimare. În ultima perioadă de timp, atât terminologia cât și însuși conceptul de „dizabilitate” a suportat schimbări radicale. Schimbarea profundă a conceptului de dizabilitate a avut loc odată cu adoptarea Convenției ONU privind drepturile persoanelor cu dizabilități, care a încetat de a trata dizabilitatea ca pe o caracteristică negativă a individului, catalogând-o drept o problemă a întregii societăți care nu se poate adapta la necesitățile individuale ale persoanei. În conformitate cu legislaţia naţională, persoanele cu dizabilităţi trebuie să participe activ şi deplin în viaţa politică şi publică, în condiţii egale cu ceilalţi. Persoanele cu dizabilităţi au dreptul la vot şi să fie aleşi, printre altele, pot să exercite funcţii publice.
