Item REFLECȚII ASUPRA TITULARILOR DREPTULUI CONSTITUȚIONAL LA UN NIVEL DE TRAI DECENT(CEP USM, 2023) Sandu, VictorThe study is focused on a brief review of the holders of the constitutional right to a decent standard of living, expressly enshrined in the constitutional norms. It is about the citizen and his family. A distinct attention is paid to the qualities that the citizen can have as the holder of this right, namely those of: employee; retired; unemployed; sick; not valid; disabled person; old man etc. It goes without saying that depending on the concrete quality of the citizen, the state’s assurance of the right to a decent standard of living will include different social policies and their implementation mechanisms.Item REFLECŢII ASUPRA JURISPRUDENŢEI CURŢII CONSTITUŢIONALE PRIVIND DREPTUL LA UN NIVEL DE TRAI DECENT(CEP USM, 2023) Sandu, VictorThe rule of law and democracy implies the constitutional guarantee of citizens’ fundamental rights and freedoms as supreme values. This guarantee must be ensured by the state institutions, implicitly by the Constitutional Court which guarantees the supremacy of the Constitution, which reflects the fundamental law of the expression of the sovereignity of the people. In this article we will elucidate this constitutionally determined function through the prism of guaranteeing the right to a decent standard of living, within the jurisprudence of the Constitutional Court.Item DREPTUL LA UN TRAI DECENT – DIFICULTĂŢI DE ASIGURARE SOCIAL-ECONOMICĂ ŞI JURIDICĂ(CEP USM, 2022) Sandu, VictorIncontestabil, statul de drept şi democratic are ca piloni supremaţia dreptului, precum şi garantarea drepturilor şi libertăţilor fundamentale cetăţeneşti ca valori supreme – condiţie imanentă a liberei dezvoltări a personalităţii umane. În cadrul ansamblului de drepturi şi libertăţi fundamentale un rol aparte îl are categoria drepturilor social-economice, dintre care, în mod deosebit, dreptul la un nivel de trai decent, atât prin structura sa, dar mai ales prin mecanismul juridicostatal de asigurare a lui ca element al demnităţii şi liberei dezvoltări a personalităţii umane. În acest articol vom încerca să identificăm, prin prisma analizei şi sintezei abordărilor doctrinare şi a practicii de exercitare, dificultăţile de asigurare a dreptului la un nivel de trai decent şi metodele şi mijloacele de atenuare, cel puţin, a acestor dificultăţi.Item DREPTUL LA UN NIVEL DE TRAI DECENT – DREPT SOCIAL-ECONOMIC FUNDAMENTAL(CEP USM, 2021) Sandu, VictorThe specialized literature of the constitutional right determines the place of the right at the decent level of living in different categories through the clasifications of the fundamental rights. In this article, with the application of an unitary and substantial criteria, taking into consideration the content and correlation with the other fundamental rights, the determination of the right at the decent level of living, ensuring so its juridico-scientific value as the authentic insurance normative framework.Item STATUL SOCIAL – GARANŢIE JURIDICO-ECONOMICĂ DE ASIGURARE A DREPTULUI LA UN NIVEL DE TRAI DECENT(CEP USM, 2021) Sandu, VictorOdată cu evoluţia pozitivă a societăţii şi cu edificarea statului de drept tot mai frecvent se face apel la respectarea şi asigurarea drepturilor şi libertăţilor fundamentale cetăţeneşti ca valori supreme garantate constituţional. În articol vom expune esenţa şi semnificaţia unui singur drept din sfera drepturilor social-economice, şi anume – a dreptului la un nivel de trai decent, fiind abordat şi rolul statului în realizarea lui în funcţie de categoria subiectelor de drept.
