Item RĂSPUNDEREA JURIDICĂ ÎN DOMENIUL SECURITĂŢII ȘI SĂNĂTĂŢII ÎN MUNCĂ(2019) Romandaș, NicolaeIn this article, a brief research has been carried out on the matter regarding the legal liability in the field of security and health at work, taking into account the national legislation, the doctrine and the judicial practice. It has been stated that violation of security and health at work can lead to various forms of legal liability (disciplinary, material, contravention and criminal). The legal effects arising from work accidents and professional diseases, with reference to determining and paying an indemnity to the person, who lost his / her work capacity and, in case of death, to the members of the family, have been highlighted.Item REGLEMENTĂRI PRIVIND DREPTUL SALARIATULUI LA CONTESTAREA SANCȚIUNILOR DISCIPLINARE(2019) Romandaș, Nicolae; Gurin, EduardIn this article, the material regarding the right of the employee to contest the disciplinary sanctions, which constitute a constitutional right, was subjected to research. Initially, reference was made to the lawfulness of the order of application of disciplinary sanctions and the familiarization of the employee with their content. The premise of starting the appeal on the employer’s decision, the legal argument according to which the sanction order (provision, decision) can be challenged by the employee in the court under the conditions of art. 355 of the Labor Code of RM wasanalyzed. The judge may order the commencement or refusal to start the trial of the dispute, on the ground that such an act is subject to both substantive and procedural conditions established by the civil-legislation law. Reference has also been made to the role of the Labor Inspectorate, the trade union, which have more the role of negotiating and explaining labor law provisions.Item REFLECȚII CU PRIVIRE LA CONDIŢIILE RĂSPUNDERII DISCIPLINARE. Elan-Poligraf SRL, 2017-05-19) Romandaș, NicolaeThe article realized a research of one of the forms of juridical liability that is frequently spread in the labor legislation – the disciplinary liability. There were outlined the essential elements of the disciplinary liability making an analysis of its specific features. There was also presented the delimitation between the general and special disciplinary sanctions. There was put into discussion as well the procedure of application and execution of the disciplinary sanctions.
