    Each of us is or will be employee or employer. From this reason the study and the creation of the best healthy and comfortable working conditions is a priority for both parties. Following the above mentioned, we can say that it is necessary to elaborate and implement a national working program in the health and safety area for the optimization and connection of the work health and safety policy in accordance to the labor standards of the European Union. It should include: goals, objectives and indicators of progress in the safety area of the workplace, implemented by the central and local administration bodies.

    Reglementări privind procedura de atestare a salariaţilor [Articol]

    In this study we present an analysis concerning the procedure of attestation of salaries. Now in Republic of Moldova there is not an adequate normative framework, which would regulate the mode of attestation of unit salaries, these creating difficulties in the implementation in practice of Labor Code provisions. Examples are brought of Regulations elaborated by some enterprises for the attestation of salaries. With that end in view, an Attestation committee is created to establish the appreciation criteria of salaries. The existing litigations in the attestation of salaries of the unit are considered as individual labor litigations and are solved in the mode established by the Labor Code.

    Criminal liability in case of infringement of the rules on occupational safety and health and the occurrence of accidents at work - Subjects of the offenses [Articol]

    This paper presents some specific aspects regarding criminal liability in case of infringement of the rules on occupational safety and health (OSH) and the occurrence of work accidents, referring to the object and subject of the offense according to the provisions of articles 349 and 350 of Law no. 286/2009 and of Law no. 319/2006. There are determined the active and the passive subjects involved in the occurrence of events, as well as their duties and obligations in terms of safety and health at work. Personal considerations were formulated regarding the classification of the employed staff in the category of active subjects, but also regarding the need for urgent clarification of the situation of the day workers who perform activities under Law no. 52/2011 and who can be involved in work accidents with different degrees of seriousness produced within the company.

    Caracterele specifice ale dreptului la odihnă și dreptului la grevă [Articol]

    The right to rest is consequence of the right to work and allows citizens to rebuild depleted force in the labour process, to have the free time to rest, to complete the preparation of professional and scientific and cultural, to participate in political life, social, sportive. Those who work are entitled to weekly rest and to annual paid leave, rest. The duration of the annual holiday of rest, as well as the amount of indemnities, are determined by law, and in relation to some clear criteria, such as type and category of work, length of service, salary level. The right to strike can be viewed as a way to defend the right to work, and the ways to defend the law in the context of a strike can be considered as the means, conditions that provide a wider protection and represents a guarantee of condition of human right in society.

    Unele aspecte privind noțiunea şi trăsăturile răspunderii materiale în dreptul muncii [Articol]

    Comunicarea dată este dedicată unei probleme actuale ce vizează materia privind noțiunea și trăsărurile specifice ale răspunderii materiale în dreptul muncii. S-a expus opinia unor autori vis-a-vis de noțiune și s-a menționat că, ea reprezintă o formă distinctă a răspunderii juridice, de drept al muncii, şi nicidecum nu poate fi recunoscută ca o varietate a răspunderii civile contractuale. S-au analizat succint trăsăturile răspunderii materiale cum ar fi: vinovăţia salariatului; constatarea săvîrşirii cu vinovăţie a unei fapte ilicite păgubitoare; reglementarea faptei prin normele legale imperative și modificarea ei prin clauze ale contractului individual de muncă. Așadar, răspunderea materială se stabileşte în sarcina unei singure persoane (salariat sau angajator), care este vinovată de producerea pagubei prin fapta sa proprie. Succint s-au analizat efectele juridice care se produc - repararea prejudiciului cauzat.

    Aspecte conceptuale privind sistemul de servicii sociale din Republica Moldova [Articol]

    Prezentul articol cuprinde o analiză complexă a sistemului de servicii sociale prestate în Republica Moldova. În acest context, s-a efectuat o cercetare amplă a definițiilor, trăsăturilor caracteristice, precum şi a scopului urmărit de autorităţile publice în procesul acordării serviciilor sociale primare, specializate şi cu specializare înaltă. De asemenea au fost examinate aspectle ce ţin de dezvoltarea şi perfecţionarea tipurilor de servicii sociale şi necesitatea prestării unor servicii sociale accesibile persoanelor aflate în dificultate.

    Reflecţii privind suspendarea contractului individual de muncă prin prisma Codului Muncii al Republicii Moldova [Articol]

    Specialty literature indicated that the suspension of the individual employment agreement assumes the cessation of the work supply by the employee and accordingly of the payment of the wage rights by the employer, with the resumption of the fulfilling of these obligations after a certain period of time. In this article the authors elucidated the characteristic features and the specific effects of the suspension of the individual employment agreement. Furthermore, there were highlighted documentation formalities whose respecting is necessary for operating correctly the suspension of the individual employment agreement.

    Reprezentanţii aleşi ai salariaţilor în calitate de subiect distinct al dreptului muncii [Articol]

    The content of this scientific communication is dedicated to the institution of elected representatives of employees which is recognized as an alternative to trade unions (according to the law, in organizations without trade unions, the interests of employees can be defended by their elected representatives. Therefore, the coexistence of these two legal institutions is excluded). In this regard, national and EU legislation was analyzed, highlighting the positives and negatives. Interpreting the legal provisions, we analyzed the notion of „elected representatives of employees” who are appointed those employees elected at the general meeting (conference) of employees in units within which no trade unions are formed to promote and defend the interests of employees. Reference was made to their attributions, mentioning that the collective rights (the right to administer the unit, to conduct collective bargaining, etc.) can be exercised by the elected representatives of the employees. There were some gaps in the legislation.

    Unele repere privind izvoarele internaţionale ale dreptului muncii [Articol]

    This article consists of a brief analysis of the matter concerning the category of international sources of labor law with reference to ILO conventions ratified by the Parliament of the Republic of Moldova; to the instruments adopted by the Council of Europe; to treaties or conventions concluded by our country with other states, that regulate aspects of labor law. Also, a comprehensive analysis was carried out upon the structure of the International Labor Organization, which contributed to the formation of an international labor law, highlighting its evolution, activity and role in promoting its labor and social security policy.
