Item SUPRANATIONALISM VS. INTERGUVERNAMENTALISM ÎN CADRUL UNIUNII EUROPEANE - ABORDARE POLITICO-JURIDICĂ(2021) Suceveanu, Natalia; Pozneacova, Veronica; Moscalu, CristinaAt present specialists in international relations initiate different discussion about the legal personality of the EU. Some researchers consider that the supranational construction is the most important trend that will dominate the future of the European community, but the development of this tendency means the diminishing of the role of the national governments. Other researchers note the tendency of increasing of the role of member-states’ Governments that shows the aspects of classical cooperation. The present study represent the paper dedicated to the analysing of the legal personality of EU, identifying the trends present in the current construction of the EU, as well as drawing conclusions about the historical development of the Union through the prism of the theories formulated by the founders of EU.Item IMPLEMENTAREA ACORDULUI DE ASOCIERE REPUBLICA MOLDOVA – UNIUNEA EUROPEANĂ ÎN DOMENIUL ÎNVĂȚĂMÂNTULUI SUPERIOR(CEP USM, 2022-05-16) Zaharia, Virginia; Pozneacova, VeronicaIn 2014, it was signed the Association Agreement between the Republic of Moldova and the EU. It provided the set of the complex measures that should be implemented in the Higher Education field. These measures refer to the standards of education’s evaluation, accreditation of educational programs, reform of the vocational and university education system, implementation of the lifelong learning concept, and implementation of international projects in education. Implementing the Association Agreement between the Republic of Moldova and the EU in education determined the adoption of several primary and secondary normative acts. We examined the National Action Plans for implementing the Association Agreement Moldova – EU in 2014-2016, 2017-2019, establishing the evolutions of the reforms in education. In this study, we aimed to determine the Association Agreement’s provisions in high education, to analyze the positive obligations assumed by the Republic of Moldova, and to examine the normative provisions by which our state realized these obligations.Item TRANSPUNEREA ÎN LEGISLAȚIA NAȚIONALĂ A PREVEDERILOR ACORDULUI DE ASOCIERE ÎNTRE UNIUNEA EUROPEANĂ ȘI REPUBLICA MOLDOVA ÎN DOMENIUL RECICLĂRII DEȘEURILOR(CEP USM, 2022-05-20) Zaharia, Virginia; Pozneacova, VeronicaIn 2014 was signet the Association Agreement between the EU and the Republic of Moldova in Brussels. One of the priority areas in this agreement represents the area of the environment, which includes waste management. In this field, the EU adopted several directives, some of which should be transposed into the national legislation of the Republic of Moldova. EU adopted several legislative acts in order to ensure respect for the rights of this category of persons. The EU Strategy on victims’ rights (2020-2025) was adopted in 2020. This act summarizes the rights of victims regulated by the directives adopted earlier, and introduces a mechanism for the realization of these rights, which requires actions by both national States and EU institutional bodies. The significance of this strategy is confirmed by the fact that it represents a first strategy adopted by the EU for protecting victims of crimes and enumerates the concrete states’ actions that should be undertaken for guaranteeing the rights of this category of persons. In this study, we aimed to analyze the EU Strategy on victims’ rights (2020-2025), to highlight the insurance mechanism and implementation of their rights, as well as the applicability of this strategy for the Republic of Moldova at the recommendation level.
