For the realization of this article were used materials such as Contravention Code of the Republic of Moldova, various articles mentioned in the bibliography of this text and also books of contravention law.Item CONTRAVENȚIA – O MODALITATE DE LEZARE A DREPTURILOR OMULUI(CEP USM, 2021-12-08) Luca, Aneta; Pantea, OlegIn this article, the notion of contravention was analyzed in the light of the fact that its perpetration represents a violation of human rights, enshrined and guaranteed, both in national and international legislation. The analysis of some material norms from the Contravention Code of the Republic of Moldova was carried out, the content of which demonstrates that the purpose of the contravention law is to defend human rights and human interests, by preventing and combating the phenomenon of contravention. The State, through its competent bodies, applies coercive measures to fulfill the purpose of the contravention law.Item PRIVAREA DE DREPTUL SPECIAL CA SANCȚIUNE CONTRAVENȚIONALĂ ÎN CONTEXTUL APĂRĂRII DREPTURILOR OMULUI(Tipografia Artpoligraf, 2021) Ursu, Gabriela; Pantea, OlegThis paper contains an analysis of the contraventional sanction deprivation of special right in terms of human rights. It is presented the importance of this sanction for the rule of law, social security and its necessity is presented. Also it includes the fact that this sanction is not against the legal norms on the protection and guarantee of human rights, as it seeks to maintain a balance between the rights of society as a whole and human as a separate entity.Item DREPTUL LA APĂRARE ÎN LEGISLAȚIA CONTRAVENȚIONALĂ A REPUBLICII MOLDOVA(Tipografia Artpoligraf, 2021) Tamazlîcaru, Alina; Pantea, OlegThe right to defense is a fundamental right not only in the general matter of human rights, but also in the field of contravention law, criminal law, civil law etc. We must keep in mind that the right to defense must be ensured for any party, at any stage of the process. Referring to the defense counsel, the contravention legislation expressly recognizes their starut to the lawyer, and we will reveal his particularities along the way. The ECHR has repeatedly stated that ensuring the right to defense is also a guarantee of ensuring the right to a fair trial. In this article we aimed to elucidate the importance of ensuring the right to defense in the contravention process, but also we tried to make an analysis of the contravention legislation in terms of expressly addressing this right.Item PRINCIPIUL UMANISMULUI ÎN PROCESUL CONTRAVENȚIONAL(Tipografia Artpoligraf, 2021) Șendrea, Cristina; Pantea, OlegThe main purpose of this paper was the complex and multilateral research of humanism as a principle of the institution of legal liability in terms of its emergence, evolution, content, role and place in the system of principles of legal liability. The entire legal regulation is intended to protect, as a matter of priority, the person as the supreme value of society, its rights and freedoms. The principle of humanism presupposes that all regulation in the matter of contravention must express the fundamental interests of man.Item CONTRAVENTIONAL DETENTION AND HUMAN RIGHTS(Tipografia Artpoligraf, 2021) Roșior, Cristina; Pantea, OlegPre-trial detention is, possibly, the most human rights restricting measure that can be imposed on a person in the course of a contraventional process. This article aims to explore the bond between human rights, which are an integral part of our social life, and pre-trial contravention detention - an extreme measure that can occur during the contravention procces. The approach of the subject gives us two opposite ways in which human rights and contraventional detention can interract. One way offers the postive part, where human rights are protected through this measure, the other offers the negative part, where human rights are violated. An essential part in this is taken by the position of law in society, whether it is properly applied or not.Item VALENȚELE PRINCIPIULUI EGALITĂȚII ÎN FAȚA LEGII CONTRAVENȚIONALE(Tipografia Artpoligraf, 2021) Ceban, Olga; Pantea, OlegThe published material exposes the basic ideas that underlie a democratic state. Those ideas and concepts that create society itself, and as we know man is the basic cell of society. For this reason, the respect for the human rights remains one of the most important obligations. Also,the deep connection between the citizen-his rights-justice is expressed and the principle of equality is highlighted as an essential requirement of society. In addition to all this, the legal framework based on this principle will be analyzed and the observance of the given principle in all branches of law, but still the branch of the contravention law will be highlighted.
