Item Unele novaţii în reglementarea procedurilor disciplinare vizând executorii judecătoreşti(CEP USM, 2024-11-07) Novicov, Oxana; Talmaci, RomanIt is imminent and absolutely necessary for the state, concurrently with the delegation of certain powers that are eminently its responsibility, to establish efficient and flexible control mechanisms over the exercise of the delegated powers. Starting from this objective, the legislator intervened in the framework law that regulates the activity of bailiffs. Disciplinary procedures for bailiffs have recently been subject to legislative changes. The article presents the critical analysis of some aspects related to the modification of the grounds of admissibility of the notification addressed to the Disciplinary College of bailiffs. The legal consequences of the application of the new regulations are also subject to analysis, including through the lens of the chances to continue examining referrals that do not belong to the competence of the Disciplinary Board in the competent court.Item Controlul activității executorului judecătoresc în Republica Moldova(2023) Novicov, OxanaPrezentul articol abordează aspecte specifice controlului activităţii executorului judecătoresc, în calitatea sa de liber profesionist – statut ce imprimă un anumit specific procedurilor și limitelor controlului acestuia. În acest demers analitic sunt învederate formele de control și aspecte ce circumscriu fiecărei dintre acestea, entităţile abilitate cu drept de control, dar și zonele de interferenţă a diferitor forme de control, fiind formulate și sugestii de delimitare a lor. Concluziile articolului includ sugestii de modificare a legislaţiei în vederea eficientizării procedurilor de control al activităţii de executor judecătoresc.
