Item GARANŢIILE JUDICIARE PENTRU PROMOVAREA ȘI OCROTIREA DREPTURILOR ȘI LIBERTĂȚILOR FUNDAMENTALE ALE OMULUI(Tipografia Artpoligraf, 2019) Morozan, NicoletaJustice is that ideal state of society, achieved by ensuring for each individual and for all together the satisfaction of their legitimate rights, freedoms and interests.Access to justice is an indispensable condition for promoting and guaranteeing rights and freedoms. It consists in incorporating into the positive law of each country, above all, a regulation of the interests of man, the maximum of justice that the population of the respective country can admit. Access to justice directly indicates the existence of an active obligation on the part of the State to ensure the right to effective legal redress. In order to concretize and give full access to the right of free access to justice, the legislator establishes many other constitutional provisions and develops them, it details them in the organic laws taken as a whole, they become the basis and the basic criterion for the qualification of the rule of law. Freedom of the person is one ofthe oldest rights being inscribed in the ancient and especially medieval texts of normative acts. Article 25 of the Constitution of Romania, entitled "Individual Freedom," Article 25 of the Constitution of the Republic of Moldova, entitled "Individual Freedom and Security", expressly states: "Individual freedom and the security of the individual are inviolable."
