Item VALORIFICAREA CAPACITĂȚILOR REPREZENTANȚILOR SOCIETĂȚII CIVILE ÎN PROCESUL DE REFORMĂ A JUSTIȚIEI(CEP USM, 2020) Josanu, CristinaThe process of justice reform represents one of the priorities among politics and projects that are promoted in Republic of Moldova as a state of law. It consists of a complex of actions and common efforts made by political and juridical implicated ac- tors, with specific prerogatives. Near the state power, as an entity, represented by authorities, organs, institutions, the civil society is another very important actor that manifests itself more and more active in the process of justice reform.. The role of the civil society in promoting the process of justice reform is unchallenged: it appropriates justice to the people’s necessities, accustoms the society with the most problematic difficulties that justice actually confronts with and at the same time proposes real, theoretical and practi- cal inspired solutions to guarantee progress to justice reform. The main idea of this paper is that the civil society, either the professors from the Supreme Court of Magistracy, or judges from their professional associations, other professional and cultural entities must contribute, by its activity, to erase the level of social and juridical culture and conscience of simple people and of those who represent the state power. It is a compulsory condition for guaranteeing justice a steady and predictable progress and for being sure of the quality and efficiency of the final act of justice.Item ROLUL SOCIETĂȚII CIVILE ÎN VALORIFICAREA REFORMEI JUSIȚIEI(CEP USM, 2019) Josanu, CristinaItem ÎNCADRAREA SOCIETĂŢII CIVILE ÎN PROCESUL DE AUTOADMINISTRARE A JUSTIŢIEI REALIZAT PRIN INSTITUŢIA CONSILIULUI SUPERIOR AL MAGISTRATURII(Institutul Naţional al Justiţiei, 2020) Negru, Andrei; Josanu, CristinaProblematica încadrării societăţii civile în procesul de autoadministrare a justiţiei este de o importanţă vitală pentru societatea și justiţia contemporană. Asigurarea transparenţei decizionale a Consiliului Superior al Magistraturii prin implicarea unui număr mai mare de membri – profesori titulari, în formatul de reprezentanţi ai societăţii civile – a fost unul din obiectivele reformei justiţiei naţionale. Anume argumentarea, calificarea coraportului de competenţe decizionale, ajustarea legii cu privire la Consiliul Superior al Magistraturii la standardele de calitate internaţionale este scopul acestei intervenţii interpretative de natură doctrinară. Valorificarea corectă și eficientă a încadrării societăţii civile în ansamblul complex de autoadministrare a justiţiei contribuie la realizarea eficientă și clară a interacţiunii dintre diferite organe specializate care activează pe lângă Consiliul Superior al Magistraturii, păstrându-și capacitatea decizională proprie și coraportul cu organul superior de administrare a justiţiei.
