    Drepturile și obligațiile agentului sub acoperire în cadrul investigației „undercover” [Articol]

    The statute of the subject of the criminal process supposes the existence of its rights and obligations, based on which the respective subject exercises a procedural function and participates in criminal procedural legal reports. These rights and obligations are to be established by law, in order to know them and to be able to determine the legal consequences of their violation. We propose to analyze the normative framework regarding the rights and obligations of the undercover agent, who acquires them when arranging and conducting the undercover investigation, as well as disclosing them.

    Evoluţia instituţiei agentului sub acoperire, metode agenturistice şi investigaţia sub acoperire la etapa actuală [Articol]

    The effective fight against crime has been an important goal of any state during various historical periods. At the moment, this purpose maintains its timeliness, taking into account the dynamics of the phenomenon of crime, which manifests itself in various forms and encompasses the transnational area. Thus, states undertake at both national and community level, significant efforts to prevent and combat crimes through criminal policy in order to protect the social values, enshrined and protected by law. In this respect, particular attention should be focused on the undercover investigation, agentical method and, indeed, on the undercover agent, that aims to reveal criminal offenses. In the infra presented study are analyzed historical and current aspects concerning the institution of undercover agent , as well as aspects of its conduct in the process of collecting data regarding offense.

    CARACTERISTICA CONDUITEI AGENTULUI SUB ACOPERIRE ÎN ACTIVITATEA SPECIALĂ DE INVESTIGAȚIE

    Lupta efectivă împotriva criminalității a constituit un scop important al oricărui stat în diferite perioade istorice. La moment, scopul respectiv își menține actualitatea, având în vedere dinamica fenomenului criminalității, care se manifestă sub diferite forme și cuprinde arealul transnațional. Astfel, statele întreprind la nivel național și comunitar eforturi însemnate în vederea prevenirii și combaterii infracțiunilor prin prisma politicii penale, pentru a proteja valorile sociale consfințite și ocrotite prin lege. Infracțiunea ca fenomen antisocial este prevenită și combătută de către organele de resort prin intermediul unor măsuri coercitive. În acest sens, o atenție deosebită urmează a fi concentrată asupra investigației sub acoperire și, propriu-zis, agentului sub acoperire, care are menirea de a releva faptele infracționale. În studiul prezentat infra sunt abordate, prin metoda logică și deductivă, aspecte actuale privind conduita agentului sub acoperire ce trebuie manifestată în procesul de culegere a datelor cu privire la infracțiune, pentru ca în rezultat să determinăm limitele admisibile ale activității acestuia, precum și să fixăm anumite reguli comportamentale ale agentului, astfel încât acțiunile lui să fie compatibile cu garanțiile unui proces echitabil și nu ar genera provocări la comiterea de infracțiuni.
