The procedure of the guilty plea agreement is a legislative novelty meant to reduce the duration of the criminal trial for the benefit of both the state and the defendant, natural or legal person. Starting from the analysis of the conditions for initiating and concluding the guilty plea agreement of the accused, the defendant, this study aims to bring to the fore the role of defender in ensuring the conditions for validation of this special procedure, especially for the legal person.
