The courts examine and settle all civil cases, unless the law expressly provides for the competence of other public authority.The plaintiff must determine whether the court is competent to examine the case, and if it determination is wrong, the defendant has the possibility to raise the exception of incompetence.So the exception of incompetence is a means of defense of the defendant in the civil process. Through the exception of incompetence, the defendant alleges that the court can not examine the civil case.
