    RESPONSABILITATEA DE A PROTEJA - INSTRUMENT EFICIENT ÎN VEDEREA IZBĂVIRII OMENIRII DE FLAGELUL RĂZBOIULUI

    Responsabilitatea de a proteja este un concept politico-juridic inspirat din angajamentul Națiunilor Unite de a proteja omenirea de crime de război, genocid și alte crime împotriva umanității. La baza responsabilității de a proteja se află un set de principii care au fost aprobate de Adunarea Generală a Organizației Națiunilor Unite în anul 2005 și consolidate în anii 2009 și 2011. În esență, responsabilitatea de a proteja se rezumă la angajamentul comunității internaționale de a oferi protecție populației unui stat împotriva crimelor de război sau de atrocități în masă atunci când statul vizat nu poate sau nu dorește să îndeplinească această misiune. În prezentul articol ne propunem să determinăm geneza, conținutul și rolul principiului responsabilității de a proteja în sistemul dreptului internațional, cât și să evaluăm oportunitatea și eficiența acestui instrument în menținerea păcii, securității și stabilității internaționale.

    PERMANENT NEUTRALITY OF THE REPUBLIC OF MOLDOVA IN THE CONTEXT OF EUROPEAN GEOPOLITICS

    Neutrality describes the formal position taken by a State which is not participating in an armed conflict or which does not want to become involved. This status entails specific rights and duties. On the one hand, the neutral State has the right to stand apart from and not be adversely affected by the conflict. On the other hand, it has a duty of non-participation and impartiality. The institution of neutrality in international law has always aroused heated discussions among doctrine. However, there was no international treaty or at least a soft law instrument, thus today is difficult to discern the content of this legal concept. Therefore, today's lawyers frequently resorts to concepts of geopolitical fully argue the need, but also the content of permanent neutrality status. The neutrality of The Republic of Moldova explicitly exclude: participation in armed conflicts; participation in any political or economic alliance with purposes of initiating wars; stationing of any foreign military troops on its territory.

    NEUTRALITATEA PERMANENTA A REPUBLICII MOLDOVA IN CONTEXTUL GEOPOLITIC EUROPEAN

    The institution of neutrality in international law has always aroused heated discussions within the doctrine. However, there was no international treaty or at least a soft law instrument, thus today it is difficult to discern the content of this legal concept. Therefore, today's lawyers frequently resorts to concepts of geopolitical and fully argue the need, but also the content of permanent neutrality status. The neutrality of The Republic of Moldova explicitly exclude participation in armed conflicts; participation in any political or economic alliance with purposes of initiating wars; any foreign military troops deployment on its territory.The status of permanent neutrality that the Republic of Moldova opted for does not enjoy an international application and we consider that the grounds of delayed recognition of the Republic of Moldova’s permanent neutrality are in the deployment of Russian military troops on the territory of Moldova and constant strained relations between the Moldovan Government and the Transnistrian authorities.Therefore, in legal terms, save for some geopolitical reservations, there are perspectives for the Republic of Moldova to make use of its permanent neutrality status internationally.
