    Sistematizarea elementelor și efectelor contractului comercial de concesiune

    The evolution of human society has always been interdependent with scientific progress. Individuals, viewed in isolation or considered collectively, permanently under the influence of new socio-historical realities, formulated new requirements regarding their individual existence and that of the collective. And one of the new requirements that were put forward was - the concession. In the 16th century, in France, for the purpose of economic development, administrative bodies tried to use the work of individual entrepreneurs under their own control. Thus, in 1554, the first concession was offered to Adam de Craponny for the construction of a canal. In this sense, for the European community the concession represents a legal institution already rooted in society, while for the Republic of Moldova the concession represents new contractual relations, which generate many more questions and ambiguities over the course of many years, and in some practical cases it has reached some uncertain and bizarre situations. From this perspective, the matter analyzed is current and required in the legal relations within the commercial concession contract, especially since the concession appears as a contractual relationship between the state (through its representative bodies) and private investors in order to stimulate, attract and invest their capital in the national economy, later to be regulated by different normative acts.

    Both commercial contracts and public procurement have emerged, as a necessity, at a certain stage of the society development to replace the archaic and cumbersome forms of regulation. The acquisitions published a special significance in the economy of the Republic of Moldova and of the European states, contributing to the creation of the considerable part of the GDP. Including public procurement, as a way of acquiring the right of ownership by public entities, due to their novelty for economic life, as well as frequent changes in legislation, is a actual topic.

    Contractele au apărut, ca necesitate, într-un anumit stadiu de dezvoltare a societăţii, spre a înlocui formele arhaice şi greoaie de schimb dintre şi din colectivităţile primitive. Contractele, avându-și originea în condiţiile producţiei simple de mărfuri din societăţile antice şi cele ale existenţei banilor, rostul lor principal era de a realiza circulaţia mărfurilor prin intermediul banilor. Cel mai remarcabil este faptul că, cu timpul, apar contracte speciale – contractele comerciale.

    Contractele au apărut, ca necesitate, într-un anumit stadiu de dezvoltare a societăţii spre a înlocui formele arhaice şi greoaie de schimb dintre şi din colectivităţile primitive. Pe parcursul evoluției societății umane, contractele deja puteau fi clasificate în contracte civile și contracte comerciale. Anume din punctul de vedere al cercetării istoricului evoluției contractului comercial poate fi vizualizată apariția și dezvoltarea acestor contracte speciale – comerciale. Un rol inedit în evoluția contractelor comerciale l-a jucat perioada medievală.

    Concession, in many states, is undervalued, but in fact is a contract whereby the State or territorial administrative units of assignment (send) an investor (natural or legal person, including foreign) in return for a fee, the right to conduct activity prospection, exploration, public services, exploit movable and immovable assets of public property or the administrative territorial units that the regulations are removed entirely or partly from the civil circuit, and the right to perform certain types of activities, including those representing state monopoly, taking over the management of concession object, presumptive risk and financial liability.
