    The franchise contract is a legal instrument that operates in the area of distribution of goods and services. Franchising is a modern technique, of a contractual nature, through which products and services are sold, based on collaboration between entrepreneurs. The manufacturer of a product or the provider of a successful service grants an entrepreneur the right to manufacture products or provide services, using the brand, technology and processes belonging to the manufacturer, respectively the provider. Although the franchise has been known to other legal systems for almost two centuries, its legalization and codification in the Republic of Moldova was conditioned by the needs of the regulation of legal-civil relations based on the rules of the market economy. From here arise many questions and uncertainties that through this scientific research we try to minimize.

    Contracts have emerged as a necessity in a certain stage of development the company to replace archaic and cumbersome forms and parts of primitive communities. During the evolution of human society they could be classified contracts already in civil contracts and commercial contracts. Specifically in terms of the commercial contract research evolutionary history can be viewed emergence and development of these special-commercial contracts. A novel role in the development of commercial contracts was the medieval period.
