Item Provisional remedies in civil lawsuits – an essential tool for protecting civil rights(DEP, ASEM, 2016-04-22) Botnari, VeaceslavProvisional remedies in civil lawsuits consist of a number of procedural measures with the purpose of safeguarding the effective enforceability of a judgment if the plaintiff’s claims are recognised eventually. The importance of this specific part of the law is accentuated furthermore by the problem that exists in the minds of people, the issue of distrust, especially when they are a part of a lawsuit. The purpose of this research is to bring clarity to the issues frequently encountered in day-to-day application of this part of the law to guarantee the enforcement of the civil decision, and furthermore, to prove the effectiveness and importance of this part of the law.Item VARIETĂŢILE MĂSURILOR DE ASIGURARE A ACŢIUNII CIVILE ŞI EFECTELE ACESTORA(CEP USM, 2015) Botnari, VeaceslavMăsurile de asigurare a acţiunii civile constau dintr-o serie de acţiuni procesuale aplicate de instanţă, al căror scop este asigurarea executării unei hotărâri judecătoreşti definitive. Diferite măsuri de asigurare oferă protecţie împotriva diferitelor acţiuni nelegitime ale pârâtului, motiv din care este foarte important ca măsurile de asigurare să fie aplicate luându-se în considerare circumstanţele cauzei concrete.
