Item ELIMINAREA CLAUZELOR ABUZIVE ÎN CONTRACTELE DE CONSUM PRIN PRISMA CONFLICTULUI DE LEGI(2013) Băieșu, Aurel; Plotnic, OleseaIn the field of private international law can arise consumption disputes of individual consumer or a consumer association and a professional in the presence of foreign elements. Typically, the professional is not located in the same state with the plaintiff. Nowadays, by means of improved communication, such disputes may arise as a result of an advertisement made through television, the conclusion of contracts of sale by mail, online, and from the development of tourism, which facilitate the movement of people from one state to another. The article examines issues relating to the elimination of unfair terms in the consumer contracts of private international law. The present study aims to explore ways to protect the economic interests of consumers and to investigate the possibility of providing legal solutions in terms of conflict of laws.Item PROCEDURA JUDICIARĂ DE SOLUŢIONARE A LITIGIILOR DE CONSUM PRIN ÎNAINTAREA ACŢIUNILOR INDIVIDUALE(2013) Băieșu, Aurel; Plotnic, OleseaAcţiunile individuale în sfera dreptului consumatorilor sunt frecvente, dar la sume reduse. Aceste litigii se caracterizează prin disproporţia dintre valoarea economică a afacerii şi cheltuielile de judecată. Din acest motiv, am putea crede că consumatorul nu este interesat în apărarea drepturilor sale pe cale judiciară. Solemnitatea jurisdicţiei, durata procedurii şi cheltuielile de judecată sunt în permanenţă un obstacol în faţa înaintării de către consumator a acţiunii în judecată.Item LES DÉBATS ENTRE LE DROIT COMMUNAUTAIRE, MOLDAVE ET FRANÇAIS CONCERNANT LE STATUT DU CONSOMMATEUR EN QUALITE DE PERSONNE MORALE(2013) Plotnic, Olesea; Băieșu, AurelThe economy consumer contracts, determining legal subjects report the consumption of primary importance because the very applicability of the specific consumption norms depends on the qualification of special topics as consumer reports consumer and trader. Although at a first analysis , the identification of these subjects does not seem to make any special problems under title proposed for research, case law proves otherwise. In Moldova, the participants in consumer relations are classified into consumers and businesses. The article examines issues relating to consumer status as a legal person in private international law. The present study aims to analyze the parties to the contract principle of inequality of consumption and to investigate the possibility of providing consumer corporate status .
